Dear Mr. Kowell:
SUBJECT:
SPECIAL INSPECTION NO. 99990001/94-007 This is in regard to a telephone conversation on April 25,1994 in which you informed Mr. John R. McGrath, NRC Region I of the fact that Empire Soils had performed work as requested in a Reciprocity Revision Sheet dated April 21,1994 prior to obtaining approval to do so in accordance with section 150.20 of 10 CFR Part 150.
The Reciprocity Revision Sheet concerned work to be performed on April 22-29,1994 in Burlington, Massachusetts and was received in this ofGce at 4:54 p.m. on April 21,1994. In view of the fact that the notiGcation was not received at least 3 days prior to the date work was to begin, speciGc approval would have been required before work could have begun.
Based on the results of this telephone conversation, it appears that your activities were not conducted in full compliance with NRC requirements. A Notice of Violation is enclosed as Appendix A and categorizes each violation by severity level in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (Enforcement Policy). You are required to respond to this letter and in preparing your response, you should follow the instmetions in Appendix A.
Please use the enclosed self-addressed green envelope when you respond to this letter to assist you in the timely processing of your response.
In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Fedemi Regulations, a copy of this letter and your reply will be placed in the Public Document Room.
