EXEMPTION FROM THE REQUIREMENTS OF 10 CFR 140.ll(a)(4) FOR THE SAN ON0FRE NUCLEAR GENERATING STATION, UNIT 1 (TAC N0. M87052)
In a letter dated February 2,1993, Southern California Edison Company (SCE) requested a revision to Indemnity Agreement No. B-31 between SCE and the l
U.S. Nuclear Regulatory Commission to eliminate the secondary financial protection requirement covering San Onofre Nuclear Generating Station, Unit 1 (SONGS 1). The NRC has determined that an exemption from the requirements of 10 CFR 140.11(a)(4) would be initially required in order to implement an amendment to the Indemnity Agreement.
In response to your request, the Commission has issued the enclosed exemption from the requirements of 10 CFR 140.11(a)(4) in which exemption from participation in the industry retrospective rating plan (secondary level financial protection) is granted

for SONGS 1.
In connection with this action, we are enclosing five copies of Amendment No. 19 to Indemnity Agreement No. B-31 amending the agreement.

This exemption is based upon a staff requirements memorandum (SRM) dated July 13, 1993, from the Commission regarding SECY-93-127. The SRM instructed the staff to allow a reduction in the amount of financial protection required of licensees of large nuclear plants that have been prematurely shut down.
The reduction in financial protection includes withdrawal from participation l
in the industry retrospective rating plan.
