ISS'JANCE OF EXEMPTION TO 10 CFR 50.54(q) FOR THE RANCHO SECO NUCLEAR GENERATING STATION AND APPROVAL OF THE RANCHO SECO EMERGENCY PLAN, CHANGE 4, "LONG TERM DEFUELED CONDITION" (TAC NO. 76792)
The U.S. Nuclear Regulatory Commission has granted the enclosed exemption from applicable provisions of 10 CFR 50.54(q), which require offsite emergency response planning for the Rancho Seco Nuc1 car Generating Station.
This exemption is Granted in response to your letter of September 20, 1990, as amended in your letter of December 20, 1990.
We find that granting this exemption is authorized by law, will not present an undue risk to the public health and safety, is consistent with the common defense end security and meets the special circumstances described in 10 CFR 50.12(a)(2)(ii) and (iii).
Additionally, the Rancho Seco Emergency Plan, Change 4, "Long Term Defueled Condition," submitted in your letter of September 20, 1990, as amended in your letter of December 20, 1990, is approved and is effective immediately.
The Exemption has been forwarded to the Office of the Federal Register for publication.
Copies of the related Safety Evaluation and related EnvironmentM Assessment and Finding of No Significant Impact are enclosed.
