Dear Fembers of the Board,

Yo,u have asked whether UCS plans to use the depositions it has requested of GPU and Staff witnesses in the reopened hearing for the purpose of preparing direct testimony or cross-examination.

We have not yet decided whether to file direct testimeny.

On some questions, such as the size of the vents and the status of their installation, it is clear that we will not have evidence to offer. On other questions, such as the ability of the B&W code to predict the effects of small breaks, the EG&G results,the RELAP5 code and the relationship of these code results to the adequacy of decay heat removal for TNI-1, we are in a peculiar position. On the record as it now stands, we believe that we have prevailed without the necessity of further direct testimony. Without knowing what GPU and the staf f intend to produce to change the record on these subjects, it is extremely difficult for us to judge whether direct testimony by UCS would be necessary or appropriate.

Thus, until we can assess GPU's and the Staff's case, we are not able to say whether direct testimony on our part will be required and, if so, on what specific subjects. One major i purpose of the requested depositions is to enable us to make those determinations. This is the practice which we have tollowed throughout this proceeding. The depositions have been invaluable in identifying with precision the technical difference between UCS and GPU and the Staff.

i Edles, Gotchy & Buck l Page Two February 2, 1983 The other purpose of the depositions is to assist in the preparation of cross-examination. If UCS does not present direct testimony, cross-exemination will become particularly crucial.

Finally, it is my experience in this case and others that depositions are greatly beneficial to the parties and ultimately to the Board in identifying the subjects in controversy so that the testimony on each side is responsive to the important questions and cross-examination is substantially reduced.

I am confident that would be the case in this instance.
