a URC-04 010 Page 2 of 4 ARTICLE I - BACKGROUND A peer review will be conducted of NUREG-0956 draft report entitled " Radio-nuclide Release Under LWR Specific Accident Conditions." This review is being conducted based on the collective consensus of the Commission, Executive Director of Operations, and the Advisory Committee on Reactor Safeguards, that the reassessment of the LWR source term is one of the highest priority tasks in the U.S. Nuclear Regulatory Commission.

ARTICLE II - STATEMENT OF WORK The Contractor will participate as a panel member of a Peer Review Group.

conducted to review a draft report, NUREG-0956, entitled "Radionuclide Release Under LWR Specific Accident Conditions." The first peer review meeting of a series of three review meetings, will be conducted on January 25 and 26,1983 at the NRC Headquarters,1717 H Street, ROOM 1046, Washington, DC, and will be chaired by Melvin Silberberg.

The first review will cover VOLUME I, which contains analyses for a PWR large dry containment design.

VOLUME II and III, which will provide analyses for BWR Mark I and Mark III and PWR Ice Condenser design, are scheduled for similar peer review meetings to be conducted (tentatively) on March 23 and 24; May 17 and 18,1983, respectively.

Each panel member will provide writter comments at the conclusion of each Peer Review Meeting in the form of a written report.

Oral comments will be pro-vided during the meeting as a participant in the review discussions.

Meetings and Travel The Contractor shall be required to attend three Peer Review Meetings of two-days duration in Washington, DC, for a total of 6 days.

Reporting Requirements _

The Contractor shall perform a preparational review of document prior to each meeting, review time not to exceed 5 days per meeting, for a total of 15 days, and submit a final report upon conclusion' of each. meeting, _to_the. Project Officer, Michael W.

ARTICLE III - TRAVEL REIMBURSEMENT Travel and subsistence will be reimbursed to the Contractor for actual costs not exceeding the rates specified below:

1.

Travel to Washington, DC reimbursed at a daily rate, not to exceed $75.00 per day.

2.

Personal car mileage allowance at the rate of 20 cents per mile.

3.

All common carrier travel reimbursable hereunder shall be via economy class rates when available.

If not available, reimbursement vouchers will be annotated that economy class accommodations were not available.

First-class air travel is not authorized.

Receipts are required for common carrier transportation, lodging, and miscellaneous items in excess of $15.00.

ARTICLE IV - PERIOD OF PERFORMANCE The period of performance under this contract shall commence on the effective date of the contract and all effort shall be completed 15 days after the date of the last meeting date presently scheduled on May 17-18, 1983.

ARTICLE V - CONSIDERATION In full consideration of the Contractor's performance hereunder, the NRC shall pay the Contractor $30.67 per hour. Travel and subsistence in accordance with ARTICLE III.

The. total amount of the contract is not to exceed $ 5,980.56 ARTICLE VI - PAYMENT Payment shall be made in accordance with Clause 2 of the General Provisions entitled " Payments" in approximately thirty days after submission of proper and correct invoices or vouchers on a monthly basis in a form satisfactory to the Contracting Officer; provided; however, that said payment (s) shall not be deemed to prejudice any rights which the Government may have by law or under any other provision of this contract.

ARTICLE VII - PROJECT OFFICER Michael W. Jankowski is hereby designated as the Contracting Officer's authorized representative (hereinafter referred to as Project Officer) for technical aspects of this contract.

The Project Officer is not authorized to approve or request any action which results in or could result in an increase in contract cost; nor terminate or settle any claim or dispute arising under the contract; nor issue any unilateral iirective whatsoever.

The Project Officer is responsible for:

1.

monitoring the Contractor's technical progress, including surveillance and assessment of performance, and recommending to the Contracting Officer changes in requirements; 2.

interpreting the statement of work; 3.

performing technical evaluation as required; 4.

performing technical inspections and acceptances required by this contract; and 5.

assisting the Contractor in the resol ~ution of technical problems encountered during performance.

NRC-04-83-010 Page 4 of 4 Within the purview of this authority, the Project Officer is authori/ed to review all costs requested for reimbursement by the Contractor and submit recommendations for approval, disapproval, or suspension for supplies or services required under this contract.

The Contracting Officer is responsible for directing or negotiating any changes in terms, conditions, or-amounts cited in the contract.

For guidance from the Project Officer to the Contractor to be valid, it must:

1.

be consistent with the description of work set forth in the contract; 2.

not constitute new assignment of work or change of the expressed terms, conditions, or specifications incorporated in to this contract; 3.

not constitute a basis for an extension to the period of performance or contract delivery schedule; and 4.

not constitute a basis for any increase in the contract price.

ARTICLE VIII - INSPECTION AND ACCEPTANCE Acceptance of the services and final report to be delivered hereunder will be made by the Project Officer.

ARTICLE IX - GENERAL PROVISIONS This contract is subject to the General Provisions entitled " Fixed Price Research and Development Contracts Under $10,000.00" dated November 14, 1977, which incorporates the FPR Changes and Additions and NRC Additions, which is attached hereto and made a part hereof.

Clause 14 of the General Provisions entitled " Patent Rights - Acquisition by the Government" is deleted in its entirety.

ARTICLE X - KEY PERSONNEL Mr. Albert Reynolds is identified as being essential to the work being performed under this contract.
