By your application dated December 10, 1982, and the affidavit of Mr. A. E.
Scherer of Combustion Engineering, Inc., dated October 18, 1982, you sub-mitted the subject documents and requested that they be withheld from public disclosure pursuant to 10 CFR Part 2.790.
Your reasons for requesting our withholding of this information were, inter alta, that it was trade secret, privileged or confidential conenercial in-formation consisting of fuel assembly con,ponent configuration and post-1rradiation examination results, which are owned and have been held in con-fidence by Combustion Engineering Inc. You also indicated that the infor-mation is not available from public sources, and consistsdof test data or other similar data concttrning a process, method or component, the application I
of which results in a substantial competitive advantage to combustion Engineering.
l You also point out the ability of Combustion Engineering's competitors to utilize such information, without an expenditure of resources commensurate with those l
i involved by Combustion Engineering, may enable them to sell at prices reflecting i
significantly lower costs.
j We have reviewed your application and material based on the requirements and j

We have also found at this time that the right of the public to be fully apprised i
as to the bases for and effects of the current evaluation effort does not out-weigh the demonstrated concern for protection of the competitive position of Combustion Engineering. Inc. Accordingly, we have determined that the informa-tion should be withheld from public disclosure.
We therefore approve your request for withholding pursuant to Section 2.790 of i
10 CFR Part 2 and are withholding the subject documents from public inspection.
