APPENDIX A Brown Boveri Electric, Incorporated Switchgear Systems Division Docket No. 99900740/82-01 NOTICE OF VIOLATION As a result of the inspection conducted on October 4, 5, and 8, '1982, and in accordance with Section 206 of the Energy Reorganization Act of 1974 and its implementing regulation, 10 CFR Part 21, the following violation was identified and has been categorized in accordance with the NRC Enforcement Policy (10 CFR Part 2, Appendix C), 47 FR 9987 (March 9, 1982):
Section 21.51(b) of 10 CFR Part 21, dated December 18, 1981, states, in part:
Each individual, corporation, partnership, or other entity subject to the regulations in this part shal1~ prepare records in connec-tion with the designs, manufacture, fabrication... modification, inspection, or testing of any facility, basic component supplied for any licensed facility or to be used in any licensed activity sufficient to assure compliance with the regulations in this part.
After delivery of the... component and prior to destruction of the records relating to evaluations (see S21.3(g)) or notifica-tions to the Commission (see $21.21), such records shall be offered to the purchaser of the.
. component.
Contrary to the above, records of evaluation had not been prepared with respect to the deficiencies identified with the Westinghouse relays, Types CO-6 and SA-1.
These relays have been incorporated into switchgear manufactured by Brown Boveri Electric, Inc., and supplied to various nuclear power stations.
This is a Severity Level V violation (Supplement VII).
