November 12, 1982 MEMORANDUM AND ORDER GE has responded to the Board's October 21, 1982, Memorandum and I

Order which inquired regarding GE's intentions with respect to the renewal applications for the G.E. Test Reactor (GETR) and Special Nuclear Materials (SNM) licenses. GE has requested deferral of con-sideration of the GETR license pending completion of the Appeal' Board's sua sponte review of the Initial Decision (LBP-82-64, 16 NRC I

l August 16,1982) issued in the show cause proceeding on the GETR.

1 However, GE wishes to move ahead with the SNM application.

With respect to the latter application, GE requests that the Board:

l 1.

Refer the application to the Director, Nuclear Material Safety and Safeguards, for disposition; 2.

Alternatively, comence proceedings before the Board with respect to the application; and l

Rule that consolidation of proceedings on this applica-tion with the GETR application is not appropriate.

The Board wishes to hear the views of Petitioners /Intervenorsl/

and NRC Staff on GE's requests. Consequently, it is this 12th day of November, 1982, ORDERED:

Petitioners /Intervenors are to resoond to GE's requests contained in its November 5, 1902, Response to the Board's October 21, 1982, Order by December 10, 1982.2/

-1/ The Board has chosen this designation in recognition of the fact that, although orally granted party status by the Board, no formal ruling has yet been made with regard to Petitioners' status or contentions.

(See Tr. 6-7, March 16, 1978).

-2/ The Board notes that on June 15, 1981, the Petitioners /Intervenors

all filed documents entitled " Substitution of Intervenor in Pro Per for Attorney of Record." However, none of these documents indicated mailing addresses for the Petitioners /Intervenors. The Board has identified the mailing address for one Petitioner /Intervenor (Cal PIRG), but has been unable to identify any other addresses.

l Consequently, by letter of even date herewith, we are requesting Petitioners /Intervenors former counsel to furnish them with copies of this Memorandum and Order, the October 21, 1982, Memorandum and Order, and GE's November 5,1982, Response, all of which have been served on him.

In their responses to this Memorandum and Order, Petitioners /Intervenors are to indicate their mailing addresses and telephone numbers.

NRC Staff is to respond to those same requests by December 20, 1982.
