Appendix NOTICE OF VIOLATION University of Missouri - Rolla Docket No. 50-123 Docket No.70-270 As a result of the inspection conducted on October 20-22, 1982, and in accordance with the NRC Enforcement Policy, 47 FR 9987 (March 9,1982),
the following violation was identified:
10 CFR 70.51(c) states, in part: "Each licensee...shall establish, main-tain, and follow written material control and accounting procedures..."
Section 2.0 of the Special Nuclear Material Handling Procedure for the University of Missouri Reactor Facility states, in part:
"To insure con-tinued compliance with the Code of Federal Regulations, these procedures shall be reviewed annually by the Reactor Supervisor. Records-of this review and any findings shall be filed in the Reactor Operation Office."
Section 3.0 of the Special Nuclear Material Handling Procedure for the University of Missouri Reactor Facility states, in part:
"The Reactor Director shall appoint in writing a Special Nuclear Material Custodian" (SNMC).

Contrary to the above,_the inspector identified through interviews and a review of records, the following discrepancies between the licensee's material control and accountability procedures and program.
a.
The licensee -failed to review their material control and _ accountability procedure.on an annual basis. This procedure was implemented in September 1977.
b.
The licensee did not appoint in writing an individual to act in the position of the Special Nuclear Material Custodian. The Reactor Engineer has been conducting the functions that relate to the SNM j
control and accountability program.
This is a Severity Level V violation (Supplement III).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written state-ment or explanation in reply, including for each item of noncompliance:
