I have recently received additional information on the status of the Staff's investigation into charges by certain individuals of faulty workmanship in the construction of Catawba. On September 14, 1982, I transmitted to you a memorandum from Harold R. Denton, Director, Office of Nuclear Reactor Regulation, to James A. Fitzgerald, Acting Director, Office of Investigation, with attachments in response to your January 26, 1932 request to be advised of developments on this subject.

Inasmuch as the new information, reflected in two memoranda and a report of inquiry, represent further investigation of these matters by the Office of Investigation, I am herewith forwarding these materials. The addresses and telephone numbers of certain named individt.als have been deleted in the interest of protecting their personal privacy.

SUBJECT:

CATAWBA NUCLEAR STATION - ALLEGATIONS OF SYSTEMATIC DEFICIENCIES IN PLANT CONSTRUCTION AND PRESSURE TO APPROVE FAULTY WORKMANSHIP By your September 3,1982 memorandum, subject above, you requested 01 assistance in' order to resolve concerns raised by intervenors R. Guild and J. Riley at a prehearing conference in the Catawba operating license pro-ceeding. These concerns related to alleged "... systematic deficiencies in plant construction and company pressure to approve faulty workmanship."

The Office of Inves.tigations' Atlanta Field Office contacted Messrs. McAfee, Floyd and Hoopingarner, the individuals identified by the intervenors as possessing information regarding these matters.

Mr. McAfee advised that he did not wish to discuss any matters with an 01 investigator as he had already made his concerns known a't the Catawba licensing hearing. ' Mr. Floyd stated that his original concerns were unfounded.

Mr. Hoopingarner advised he had no new concerns but wculd appear as a witness at future hearings.

Results of these contacts are containcd in the enclosed Report of Inquiry. Additionally, i

i Mr. Carl Alderson, Region II (FTS 242-5505), advised 01 that Mr. Hoopingarner l

has spoken to Region II inspection personnel on several occasions.

The issues Mr. Hocpingarner raised are discussed in Region II Inspection Reports 50-413/80-08 and 50-413/80-19.

SUBJECT:

Alleged Improper Construction Practices On August 24, 1982, Mr. Robert Guild, Attorney representing the Palmetto Alliance, was contacted in an effort to locate Mr. W. R. McAfee and Mr. tiolan Hoopingarner.

Mr. Guild stated that he is representing both McAfee and Hoopingarner and that he could speak for both of them.

Mr. Guild indicated that because of-the possibility of a new hearing with tiRR, neither wished to talk to NRC prior to the hearing.

Guild declined to release a current address and telephone number for McAfee and Hoopingarner.

~m On August 26, 1982, McAfe'e was contacted telephonically and stated that he has said all he had to say at the licensing hearing and did not wish to discuss the matter with an tiRC Investigator at this time.

McAfee said he would get with his attorney, Mr. Guild and if he changed his mind would contact tiRC.

On August 26, 1982, Hoopingarner was contacted and stated that everything he had to discuss with tiRC had been brought to their attention on previous occasions but that they failed to pioperly investigate his concerns.

He indicated that '

Mr. Maxwell, the NRC Resident at Catawba seemed to agree with his original concerns.

Hoopingarner said he had absolutely no new concerns but would appear as a witness for the Palmetto Alliance at future liRR hearings.

He related that he is not anti-nuclear but that there are some constructural defects in the Catawba -

plant.

During his original conversation with a welder who works at Catawba, he was lef t with the impression that the welder was required by a supervisor to commence welding on safety related welds before specified temperatures had been reached.

Mr. Floyd stated that he has since learned frcm the welder that this had nothing to do with construction works at Catewba but was an incident that occurred during his certification testing.

.' ig From 01: Atlanta Sept. 23, 1982 conversations with two other welders who work at Catawba during which he attempted to obtain specific information concerning improper welding practices at Catawba. Mr. Floyd indicated that not only were they not able to relate any improper welding practices but left him with the impression that Duke Power Company was going overboard to insure that the construction work was being properly performed.

Mr. Floyd cited the example that if the documentation was improperly prepared on a weld, Duke Power Company would have the weld removed and replaced.

He further indicated that the welders also informed him that the engineers that were making the decision on construction problems from the corporate off-site offices have now moved onto the site and this seems to have helped resolve some problems that had previously existed.

Mr. Floyd concluded by stating that he lives only three miles from Catawba wants to feel comfortable about the construction of the site a'nd that if he becomes aware of any addi-tional info,rmation he would either notify Mr. Riley or the liRC.
