James A. FitzPatrick Nuclear Power Plant Docket No. 50-333 Proposed Change to Technical Specifications Regarding Fire Protection System Testing

Dear Sir:

Enclosed for filing are three (3) signed originals and nineteen (19) copies of a document entitled, " Application for Amendment to Operating License," together with forty (40) copies of Attachment I and II thereto comprising a statement of the proposed changes Technical Specifications and associated Safety Evaluation.

These proposed changes clarify the High Pressure Water Fire Protection System surveillance requirements in Section 4.12.A.1 l (pages 244a and 244b) . In Section 4.12.A.l.e, the word " system" l

is deleted to make the terminology consistent with that used throughout Appendix A; and in Sections 4.12.A.l.e.1 and 4.12.A.l.e.4, references to an operating sequence are deleted because of possible erroneous implications.

! Further, this change will resolve NRC Inspection and Enforce-ment Unresolved Item No. 81-15-02.

The proposed changed pages are Attachment I to the Application for Amendment enclosed with this letter, while the associated Safety Evaluation is Attachment II.

. ~2-i The Authority has classified this Application for Amendment as Class II since the proposed changes serve only to clarify existing surveillance requirements and therefore have no safety or environmental significance.

Enclosed is a check in the amount of $1,200.00 as the amendment fee as per 10 CFR 170.22, which the Authority pays under protest pending a final determination of the legality of the fee schedule.
