APPENDIX A NOTICF OF VIOLATION Power Authority of the State of New York Docket No. 50-333 J. A. FitzPatrick Nuclear Power Plant License ho. DPR-59 As a result of the inspection conducted on August 1-30, 1982, and in accordance with the NRC Enforcement policy, (10 CFR 2, Appendix C) published in the Federal Reaister Notice (47 FR 9987) dated March 9,1982, the following violations were identified:

Environmental Technical Specification 2.3.B.10 req)uires that the containment A.

be purged through the Standby Gas Treatment (SBGT system.

Contrary to the above, from June 1, 1979 to October 31, 1981 and from April 9, 1982 until August 23, 1982, the continuous purging of the containment during normal reactor operation was not through the SBGT system.

This is a Severity Level IV Violation (Supplement I).

B.

Technical Specification 6.4 requires that a training program be maintained under the direction of the Training Coordinator to assure proficiency of the plant organization. James A. FitzPatrick Indoctrination and Training Procedure ITP-3, " General Employee Training," Revision 2, Section 3.5.9 l

requires annual requalification in Radiation Protection.

Contrary to tha above, as of August 27, 1982, annual requalification in Radiation Protection was not provided for sixteen individuals during the last fifteen months.

This is a Severity Level V Violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, The Power Authority.0f the State of New York is hereby required to submit to this office within thirty days of the date of this Notice, a written statement or explanation in reply, including:

corrective steps which will be taken to avoid further violations, and (3)(2)

(1) the corrective steps which have been taken and the results achieved; the date when full compliance will be achieved. Where good cause is sh6wn, consideration will be given to extending your response time.
