SECY-82-364 - ALAB-680, Denial of Stay Motion on San Onofre Initial Decision The Commission, by a vote of 4-l* (Commissioner Roberts dia-approving), approved an Order, as modified by Commissioner Ahearne, that declines review of ALAB-680 and directs certifi-cation of the offsite medical arrangements issue directly to the Commission.
Commissioner Roberts voted to disapprove the Order because he would not certify the offsite medical arrangements issue.
(Subsequently, on September 24 the Order was signed by the Secretary.)

- Section 201 of the Energy Reorganization Act, 42, U.S.C.
E 5841, provides that action of the Commission shall be determined by a " majority vote of the members present."
Commissioner Roberts was not present when this item was affirmed, but had previously indicated that he would disapprove.
Had Commissioner Roberts been present, he would have affirmed his prior vote.
Accordingly, the formal vote of the Commission was 4-0 in favor of the decision.
