Report No. 50-389/82-28

This refers to the routine safety inspection conducted by Mr. J. W. York of this

office on June 21-25, 1982, of activities authorized by NRC Construction Permit

No. CPPR-144 for the St. Lucie 2 facility. Our preliminary findings were dis-

cussed with Mr. B. J. Escue, Site Manager, at the conclusion of the inspection.

Areas examined during the inspection and our findings are discussed in the

enclosed inspe:: tion report. Within these areas, the inspection consisted of

selective examinations of procedures and representative records, interviews with

personnel, and observations by the inspector.

During the inspection, it was found that certain activities under your license

appear to violate NRC requirements.

Thase items and references to pertinent

requirements are listed in the Notice of Violation enclosed herewith as

Appendix A.

Elements to be included in your response are delineated in

Appendix A.

The violation described in Item A of Appendix A is similar to the violation con-

tained in the Notice of Violation sent to you with our letter dated September 14,

1981.

"Similar violations", as described in the NRC Enforcement Policy, are

subject to escalated enforcement action.

Accordingly, in your response to the

enclosed Notice, please give particular attention to the identification and

remedy of the root cause of the violation so that its further occurrence may

be precluded.

We have examined actions you have taken with regard to previously identified

enforcement matters. These are discussed in the enclosed inspection report.

In accordance with 10 CFR 2.790(a), a copy of this letter and the enclosures will

be placed in the NRC's Public Document Room unless you notify this office, by

telephone, within ten days of the date of this letter and submit written

application to withhold information contained therein within thirty days of the

date of this letter. Such application must be consistent with the requirements

of 2.790(b)(1).

The responses directed by this letter and the enclosures are not subject to the

clearance procedures of the Office of Management and Budget as required by the

Paperwork Reduction Act of 1980, PL 96-511.
