SECY-91-091 - Federal Reaister Notice and Commission OrdeE on Louisiana Enerav Services' Application for License The Commission, by a 4-0 vote,* approved a Federal Reaister dotice and Commission order regarding Louisiana Energy Services' application for a license to possess and use byproduct, source and special nuclear material and to enrich natural uranium to a maximum of 5 percent U-235 by the gas centrifuge process.
Sect'.on 193 of the Atomic Energy Act requires a single adjudicatory hearing for the licensing of uranium enrichment facilities.
The Notice and Commission Order include a notice of hearing, notice of intent regarding classified information, anu related matters.
(Subsequently, on May 15, 1991, the Secretary signed the Order.)
Section 201 of the Energy Reorganization Act, 42 U.S.C.
Section 584), provides that action of the Commission shall be determined by a " majority vote of the members present."
Commissioner Rogers was not present due to official travel when this item was affirmed.
Accordingly, the formal vote of the Commission was 3-0 in favor of the decision.
l Commissioner Rogers, however, had previously indicated that he would approve this paper and had he been present he would have affirmed his prior vote.
