j APPENDIX A NOTICE OF VIOLATION Northeast Nuclear Energy Company Docket Nos. 50-245 Millstone Nuclear Power Station, Units 1, 2, and 3 50-336 50-423 License Nos. OPR-21 OPR NPF-49 As a result of:the inspection conducted on March.4-8, 1991, and in accordance with the " General Statement of Policy and Procedure for NRC Enforcement
- Actions," 10 CFR Part '2, Appendix C (Enforcement-Policy) (1990), the following violations were identified:
-License Condition E to facility Operating License Nos. DPR-21, OPR-65 and NPF-49, dated December 10, 1984, requires that the licensee fully implement l
and maintain all_ provisions.of the NRC-approved Physical Security Plan.

The NRC - approved Millstone Nuclear Power Station Physical Security Plan, Revision 13, dated July 1990, Section 13.5, Security Personnel Equipment, states,. in part, that weapons are inspected upon issue daily _and. tested every twelve (+/-) 2 months.
._ Contrary to the above, on March 7 -1991, twenty-five handguns and twenty-six shotguns were identified for which there was no documentation to indicate that they were tested within the required time period.
This is a; Severity Level V Violation (Supplement-III).

Appendix-G, to 10-CFR 73, " Reportable Safeguard Events,"
Paragraphil, " Events to be reported within one hour of discovery, followed by a written report within;30 days,"
subparagraph-(d) includes "the actual or attempted introduction of H
. contraband into a protected area,'. material access area, vital area,.or' transport." The Millstone Access Control Procedure, ACP 7.05,; Revision 44, Page 8,.Section 6.7.1 states that all personnel _are subject to search each time they enter the Protected Area. ' Searches are' conducted for items of contraband
- such as alcohol, controlled drugs (prescribed),. illegal drugs etc.
In addition,'the Millstone Administrative Control Procedure, ACP 7.13, Revision _1, Page 3, Section 4.5.1
" Safeguards Events To Be. Reported with One (1) Hour,"
Subsection 4.5.1=.1 states,_in-par.t, that certain s.ignificant safeguards events must be telephonically _ reported to-the NRC withi_n one hour of discovery of the event and_ a detailed written report (SER) must follow within 30 days.
These one hour reportableJsafeguards-events include' actual or attempted j
' introduction of contraband-into a PA or VA.
Contrary to the above on_ August 10, 1990, the licensee investi -
-gated the introduction of contraband (alcohol) into the Protected Area.by a security officer on August 2, 1990.
The licensee-
-determined that'the-security officer had unintentionally brought a caniof beer into the PA and failed to report:it to his o
supervisor when he became aware of it.
The licensee did-not l
report the event _to-the NRC b'y-telephone nor.was;a written l'
. report submitted within;30 days. Additionally, the event was.
not documented.'in.the security log-that is required to be-submitted to;the NRC.each calendar quarter.
This is a Severity-Level IV! Violation.-(Supplement'III).

Where good
-cause is_shown, consideration will be given to' extending this response time.
