Gentlemen:
SUBJECT: REPORT NO. 50-335/83-21
Thank you for your letter of July 25, 1983, informing us of steps you have taken
to correct the violation concerning activities under NRC License No. DPR-67
brought to your attention in our letter of June 24, 1983.
Our letter dated
August 5,1983, indicated that your request for withdrawal of the violation or
mitigation of its severity level was being evaluated and that we would inform you
of our conclusion at a later date. We have reviewed your response and agree, in
part, with its conclusions. While we agree that " licensees are not ordinarily
cited for violations resulting from matters not within their control,". this
particular violation does not fit that category because you intentionally ~
introduced wet mop heads into this shipment without recognizing they could cause
condensation. We continue to believe that any amount of water in radioactive waste
trash shipments is a violation of the burial facility license and, therefore,10 CFR 20.301. Consequently, this violation stands. However, our evaluation of your
response leads us to agree that the safety significance of the violation is minimal
and we have reclassified it as Severity Level V.
Our records will be modified to
reflect that change. We will examine your corrective actions and plans during
subsequent inspections.
