Dear Administrative Judges:

In its Order of July 18, 1983, this Board, inter alia, granted the MassAG's motion to extend the time to file rebuttal testimony to August 8, 1983. The Board, moreover, made that deadline applicable to all parties. Attached herewith is the rebuttal testimony of Michael Kaltman and the rebuttal testimony of Dr. Thomas Urbanik II to the filed direct testimony of Philip B. Herr on NECNP Contentions III.12/III.13. However, this testimony is filed with the reservation that, in the Staff's view, it is rebutting portions of Mr. Herr's direct testimony that are not relevant to Contentions NECNP III.12/III.13 as restated by the Board in light of its Memorandum and Order of June 30, 1983. The Staff will pursue this point when the proffered testimony of the MassAG is offered into evidence,1/ but the irrelevant portions include, but are not limited to, the folTowing sections of Mr. Herr's testimony:

At that point in time the Staff will also raise objections to the admission of the testimony of MassAG witnesses Mark, Shaheen, and Kuncho.
