Thank you for your June 1,1983 letter which responded to our April 25 letter regarding fees per 10 CFR 170.22 for five applications for Unit No.1 of the Three Nile Island Station. We agree with the fee position taken in your letter and the fact that your company is due a refund of $1,900, except for one item.

Based on a May 9,1983 (TSCR-125) resubmittal of your February 2,1983 TSCR-123, the exception is that since fees were paid (Classes II and IV) with your May 9 application for the steam generator repair program review, the Class II fee of $1,200 is not applicable to your February 2 request on steam generators.

Consequently, your company is due a refund of $3,100 rather than $1.900. Since we have the following applications for which your company has not remitted fees, the $3,100 will be applied to these applications:-

TSCR No. 95 dated September 30, 1980, on the definition of operable as requested by an NRC letter dated April 10,1980, and l

2.

TSCR No. 105 dated June 8, 1981, on snubbers as requested by an NRC

. letter dated November 20,1980.

Although the above applications were requested by the NRC, they were not re-quested for the purpose of simplifying or clarifying the license or technical l

..specificatioris for the convenience of the NRC, but rather to assure safety

system availability and operability. Therefore, they are not exempt from fees i

under the provisions of Footnote 2 of 10 CFR 170.22. Licensees have paid fees, or are being requested to pay fees, for them.

l The Division of Licensing (DL) staff has determined that a Class III fee of

$4,000 is applicable for each of the above two requests because the review will be more than administrative or pro forma in nature. As a result, a total 8308080606 830722 PDR ADOCK 05000289 p

~ JUL 2 21983 of $8,000 is due the NRC for them. Since we are applying the $3,100 due your company to the $8,000 due the NRC, a balance of $4,900 is due for items 1 and 2 above. It is requested that this amount be remitted to our office. If the DL staff's final review of any of the pending applications reveal that any of these fees are not correct, you will be notified and any necessary adjustments will be made.
