The Comission has issued the enclosed Exemption from certain requirements of Appendix J to 10 CFR Part 50 for the Big Rock Point Plant in response to your letter dated June 21, 1983. This exemption is being forwarded to the Office of the Federal Register for publication. lhe Exemption pertains to the requirement to perform integrated containment leak rate tests during every refueling, until two successive tests are successful, once two successive tests fail to meet the applicable acceptance criteria.

LEAK RATE TEST EXEMPTION The Commission has issued the enclosed Exemption from certain requirements of Appendix J to 10 CFR Part 50 for the Big Rock Point Plant in response to your letter dated June 21, 1983. This exemption is being forwarded to the Office of the Federal Register for publication. The Exemption pertains to the requirement to perform integrated containment leak rate tests during every refueling, until two successive tests are successful, once two successive _ tests fail to ieet the applicable acceptance criteria.

Your letters to J. G. Keppler of Region III cated May 6,1983 and qyself dated May 25, 1983, indicate that Consumers Power Company does not agree with the NRC's current interpretation of the acceptance criteria for Type A i-tests. We are considering your arguments and the NRC staff intends to provide generic information to all licensees and to the NRC Regional Offices further clarifying the criteria in the near future.
