., j By letter dated March 28, 1983, you requested pursuant to 20.302, tnat we evaluate three proposed alternate modes for disposition of quantities of slightly contaminated charcoal removed from air filtration units at Rancho Seco. We have completed our review of the information you provided on the proposed alternate modes and found each mode acceptable provided the appropriate approvals and licenses are obtained from the relevant State or Federal agencies.
Our evaluation is provided in the enclosure.

- 1) Option 1:
Land burial in a local county landfill (California).
Comment:
This option is acceptable.
Pursuant to 10 CFR Part 150, the NRC has delegated the authority to regulate byproduct material in the State of California to the California Department of Health Services. Thus any approval for burial of byproduct material in the State of California in a land fill must be issued by that agency.
In addition, other California State and local regulatory agencies may have some jurisdiction in this area.
Therefore, our acceptance of this option is predicated upon approval by relevant state and local agencies.
- 2) Option 2:
Reclamation by a supplier of nuclear quality charcoal.
Comment:
This option is acceptable if the recipient of the contaminated charcoal has a license issued by the NRC pursuant to 10 CFR Part 30, 33, 40, or 70 or a license issued by an Agreenent State to engage in this actiYity.
- 3) Option 3:
Use in air filtration system at a nuclear facility cperating under a California license.

This option is acceptable to the NRC, provided that the transfer of the subject material is performed in accordance with all relevant regulations of the State of California.and the U. S. Department of Transportation, and that the California licensee is properly licensed to receive and use the material.
