Dear Mr. Chairman:

In your letter of June 23, 1983, you posed a series of questions relating to the strike now under way at Consolidated Edison's Indian Point Unit 2 plant and the implications of that strike for the' state of emergency planning and pre-paredness at the plant. Those questions are currently under review by the NRC staff.

"What assurances does the Commission have that the functions intended to be performed by the employees of Con Ed, now on strike, will be performed in

the event of an accident during the strike?

With regard to the onsite emergency organization, most of these positions are..

normally staffed by non-union management and technical resources. The utility made the necessary adjustments and is currently staffed in excess of their emergency plan commitments. The relatively small number of positions normally staffed by union personnel have been supplemented by additional trained utility technical and management personnel.

Supplemental training, where needed, was provided before the strike began. The utility's contingency staffing, both for routine operation and, emergency preparedness, has been reviewed by our Region I staff and the resident inspectors.

With regard to offsite support, both utilities, (Con Ed and PASNY) have informed us that they are continuing to honor their recent commitments to make resources available to the State and local governments in order to address the deficiencies identified by FEMA. As before, the Power Authority has agreed to take the lead in this endeavor.

In accordance with the original commitment between Con Ed/PASNY/NRC, training is being provided for Con Ed participants committed to responding to any emergency at Indian Point. Although non-union staff have been selected for participation in the offsite response and trainin,g, union personnel who were originally selected will be invited to attend the training classes.

If other than utility personnel will be utilized, what assurance does the Commission have that such personnel will be available in a timely manner?

The emergency response plan as previously approved envisions use of non-utility personnel in selected technical areas. Their participation is not expected to be changed in light of the strike.

Such contractor personnel are routinely being provided access to the Indian Poi.nt Unit 2 site.

To date no problems regarding personnel access to the site have been encountered.

On what date does the Commission anticipate the conduct of the drill?

l As we understand it to date, the drill is scheduled to be conducted in approxi-mately 60 days from our June 9 decision that permitted continued operation at Indian Point, which would be mid-August. The utilities have assured us that they are working.to satisfy this time frame.

Furthermore, recent communications with l

FEMA and the State of,New York indicate that they are making the necessary i

preparations to support the drill schedule; however, there is some indication that the State may want to consider a delay. FEMA and the State are planning to meet June 29, 1983 to decide on a schedule.

What effect will the strike have on the conduct of this drill?

The staff has discussed offsite staffing with the licensee.

part of the onsite contingent operating the plant. The strike, assuming it continues, should have no affect on the drill, since the drill will be designed to test the FEMA identified deficisncies which are related to Rockland and-Westchester Counties, and will not directly affect site activities.

"What effect will possible postponement of the planned drill have on the Commission's finding that " adequate compensation measures have been, or shortly will be taken for those areas in which shortcomings still remain..."

The Commission will continue to review the strike related activities and the conduct of operations at the Indian Point site along with the preparations for the upcoming drill.
