APPENDIX A NOTICE OF VIOLATION Power Authority of the State of New York Docket No. 50-333 James A. FitzPatrick Nuclear Power Plant License No. DPR-59 As a result of the inspection conducted on April 1-30, 1983, and in accordance with the NRC Enforcement Policy (10 CFR 2. Appendix C) published in the Federal Register on March 9,1982 (47 FR 9987), the following violation was identified:

A.

10 CFR 50, Appendix B Criteria XII, Control of Measuring and Test Equipment, requires measures be established to assure that tools, gages, instruments, and other measuring and testing devices used in activities affecting quality are properly controlled, calibrated, and adjusted at specified periods to maintain accuracy within necessary limits.

I The following are examples of the licensee's failure to properly implement or establish procedures to assure proper control and calibration of measuring and test equipment.

Administrative Procedure (AP) No. 4.2, Control of Measuring and Test Equipment, Revision 2, Section 6.7, requires that records of calibration be maintained so that calibration status can be determined.

Contrary to the above, as of April 19, 1983, no current calibration records were available for two torque wrenches (serial numbers BB24182 and 1144), six ameters (serial numbers E-530. E-550, E-561, E-547. E-579, and E-549), and one negohmeter (serial number E-571).

All of the equipment, with the exception of torque wrench 1144 which could not be located, had current calibration stickers attached and were in use.

Administrative Procedure No. 4.2, Section 6.6, requires that when measuring and test instruments used on safety-related equipnent or systems are found to be out of calibration, an investigation shall be made of the results and data obtained with the effected instruments.

The results of this investigation are required to be documented.

Contrary to the above, as of April 19, 1983, no investigations were done on three multimeters (serial numbers E-503, E-695, and E-693),

two ammeters (serial numbers E-697 and E-698), and two torque wrenches (serial numbers AA01814 and M-56), all of which were found to be out of calibration or defective during periodic recalibration.

ANSI N45.2-1971, Quality Assurance Program Requirements for Nuclear Power Plants, Section 13, requires that measures be established and documented to assure that test and measuring equipment used in 8306060234 830523 DR ADOCK 05000 3

activities affecting quality are of the proper range, type and accuracy to verify conformance to established requirements.

Contrary to the above, as of April 19, 1983, the licensee failed to establish adequate controls to assure that test and measuring equipment was of the proper accuracy and range as noted in the following exampics:

Two torque wrenches, serial numbers C25556 and M-117, each had two out of tolerance values during their last calibration on January 27, 1983 and September 11, 1981, respectively.

These values were not identified as being out of tolerance by the licensee, and these torque wrenchas were available for use.

Three 0-600 foot-pound torque wrenches, serial numbers M-60, A06254 and 180585A, were calibrated on equipment capable of measuring only up to 500 foot-pounds. These torque wrenches were not marked in any way to indicate that they had only been calibrated up to 500 foot-pounds.

This is a Severity Level IV Violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201. The Power Authority of the State of New York is hereby required to submit to this office within 30 days of the date of the letter transmitting this flotice, a written statement or explanation in reply, including for each violation:

(1) the corrective steps which have been taken and the results achieved; (2) the corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
