Dear Mr. King:

This letter acknowledges receipt of your letter to Chainnan Palladino dated March 23,1983, submitted on behalf of the Three Mile Island Public Interest Resource Center.

In your letter, you ask that the NRC immediately halt all work at Three Mile Island Units 1 and 2 (THI-l & 2), with the exception of maintenance necessary for safety. Your request is based upon the allegations of Richard D. Parks concerning implementation of the quality assurance program 6

and related areas. Your letter has been referred to my office for treatment as a request for action pursuant to section 2.206 of tho Commission's regulations.

The licensee is involved in a number of activities at TMI-1 beyond those neces-sary to maintain the unit in a safe and stable condition.

The major activities necessary prior to the restart that are currently being conducted include repairs to the steam generators, work in connection with the installation of vents in the primary system, and testing of containment isolation, the secondary system, effluent monitors, and post-accident in-containment monitoring systems.

It has been over four years since the accident at TMI-2.

Conditions inside the reactor have been stabilized and progress by the utility has been made towards the ultimate goal of decontaminating and defueling the plant and the safe disposition of radioactive wastes. The licensee is presently engaged in a multifaceted progran designed to accomplish this goal. Many portions of this program are specific to the cleanup effort which is necessary not just for the maintenance of the facility in a safe condition but also for l

long tenn safety.

The highly contaminated liquid waste water from the accident has been proc-essed using demineralizers. To reduce contamination inside the reactor and

My staff has conducted a preliminary assessment of the allegations and has determined that the issues raised in the affidavits do not materially change our assessment of risk to workers and the public associated with the Unit 2 planned cleanup activities or the licensee's efforts to ready Unit 1 for possible restart. All safety related procedures for activities at Unit 2 undergo a safety review by the NRC staff prior to implementation.

Any procedures or activities judged by the staff to present an unacceptable risk are not approved. Moreover, the NRC has a substantial presence at the site to monitor ongoing activities. The activities scheduled at Unit 2 over the next several months do not pose a significant potential hazard to the public such that a halt to all currently authorized activities is warranted pending closer examination of the Parks' allegations.

Unit 1 is not currently authorized to operate, thus the preparatory activities do not pose an imminent threat to public health and safety.

Continuation of activities at this time would not interfere with our ability to assess the adequacy of such activities or the merit of the Parks' allegations. Therefore ordering, as you request, an immediate halt to all work at TMI, except for maintenance necessary for safety, does not appear, on the basis of the allegations, to be necessary or appropriate at this time.

The NRC's Office of Investigations (01) is currently conducting an inquiry into the allegations made by Mr. Parks.

I will take appropriate action on your petition within a reasonable time in light of the results of the OI investigation and other pertinent information.

I enclose for your information a copy of the notice that is being filed for publication with the office of the Federal Register.
