- i; APPLICANT'S REQUEST FOR PERMISSION TO REPLY TO THE HARTSVILLE GROUP'S OBJECTION TO ORDER FOLLOWING SPECIAL PREHEARING CONFERENCE On April 26, 1983, Hartsville Group filed with the Board a document entitled The Hartsville Group's Objection to Order Following Prehearing Conference and Motion for Referral.
The document seeks reversal of the Board's denial by Memorandum and Order, dated April 12, 1983, of Hartsville Group Conten-tions 4, 5 and 9.
Hartsville Group further requests, if the Board decides not to reverse its Order with respect to Conten-tion 4, that the Board refer its ruling on that contention to the Appeal Board.
Applicants believe there is no question of their right to reply to Hartsville Group's motion for referral and expect to do so by May 11, 1983.
With respect to Hartsville Group's objections to denial of its contentions, however, Sections 2.751(d) and 2.752 (c) of the Commission's Rules of Practice prohibit replies by other parties to objections to prehearing 8305090470 830504 w

k-conference orders except by direction of the Licensing Board.
While these regulations expressly refer only to construction permit and operating license proceedings, they may also be applicable to license amendment proceedings.
Applicants there-fore request that, in keeping with the schedule set by NRC's regulations for replies to the Hartsville Group motion for re-ferral, the Board set May 11, 1983, for Applicant's reply and May 16, 1983, for the NRC Staff's reply to the Hartsville Group objections.
Applicant's counsel has been authorized by the representative of the Hartsville Group and by NRC Staff counsel to state that they have no objection to this request.
