Dear Mr. Hafner:

This responds to the concerns you expressed in your letter of December 2, 1982 regarding the responses to F01 A-82-4$5, F01 A-82-471 and F0I A-82-479.

The documents listed on Appendix A are responsive to your concerns.

Documents 1, 2, 5, 6, and 8 of Appendix A are enclosed.

The enclosures to documents 3 and 4 which are listed on Appendix A and the report enclosed with document 7 which is listed on Appendix A contain information which the licensee considers confidential business (proprietary) information.

This information is being withheld from public disclosure pursuant to Exemption (4) of the Freedom of Information Act (5 U.S.C.

552(b)(4)) and 10 CFR 9.5(a)(4). We have asked the originators of this information to review their proprietary claim, and will let you know as soon as possible whether the documents, or any portions thereof, may be disclosed to the public.

A copy of the documents without the proprietary enclosures are enclosed.

For your information document 8 of Appendix A is a report entitled

" Suppression Pool Temperature Limits for BWR Containments." This report contains the NRC's position on this issue.

Document 9 of Appendix A is an excerpt from NUREG-0420, Supplement 1, Safety Evaluation for Shoreham.

The excerpt contains a discussion of the suppression pool temperature limits for Shoreham.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Mr. Harold R. Denton, Director, Office of Nuclear Reactor Regulation.

This denial may be appealed to the Commission's Executive Director for Operations within 30 days from the receipt of this letter.

As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."
