Re: Revision to Facility Operating License for the Penn State Brear.cale Reactor, License No. R-2, Docket No. 50 05 Dear Sir or Mndamt A revision is hereby proposed for the Penn State Breareale Reactor (PSDR) Facility Operating License No. R 2.

During the issuance of Amendment No. 24 to the R 2 license, which deleted the authorization to possess reactor fuel elements containing high-enriched uranium, the wording in part 2.B.(2) of the license was changed so that the licensee was allowed "to receive, possess, and use in connection with the operation of the reactor, up to nine (9) kilograms of contained uranium 235 enriched to less than 201,." Previous to amendment No. 24, the wording " enriched to less than 201." was not in the license; this wording prohibits the use of special nuclear material such as fission chambers or fission foils of uranium 235 enriched to 20't or greater in connection with the operation of the reactor.

The lleensee requests that part 2.B(2) of the R 2 license be amended to read as follows, "to receive, possess, and use in connection with the operation of the reactor, up to nine (9) kilograsas of contained uranium 235 enriched to less than 20't in the form of fuel elements and up to fif ty (50) grams of contained uranium 235 without limit as to enrichment in forms such as fission detectors or fission foils, and to possess but not separate such special nuclear material as may be produced by the operation of the reactor."

An exemption of fees for the licensing action is requested under the provisions of 10 CFR Part 170.11 (a) (4).
