SUBJECT:
ORDER IMPOSING A civil PENALTY - DUKE POWER COMPANY CATAWBA, MCGUIRE AND OCONEE - EA 89-151 A proposed imposition Order with Appendix is enclosed for your review.
In their response of January 31, 1990, Duke admitted the violations but argued that enforcement discretion should be exercised or that the civil penalty be fully niitigated based on corrective actions taken by Duke Power Company.
This was one of two enforcement cases discussed with Duke management at a meeting on January 31, 1990.
After reviewing the licensee's response, we have concluded that no rritigation of the proposed civil penalty is warranted.
