Dear Congressman Markey:

In view of the interest you expressed in previous corres-pondence regarding the Nuclear Regulatory Commission's (NRC's) oversight of TMI Action Plan item implementation by our licensees, I am writing to provide you the latest information available to me on the status of this effort.

This information reflects the NRC staff's most recent review of licensae actions and commitments in this area and is current through February 1990.

A copy of the staff's February 22, 1990 report to the-Commission on this matter is enclosed.

Over 98 percent of the TMI Action Plan requirements have been implemented at the 113 currently licensed facilities.

Of 19,436 possible TMI Action Plan items,13,744 were found applicable when reviewed against each licensed reactor.

These figures have increased since our last report to you as a result of the addition of Limerick 2 to the list of licensed reactors.

Of the currently applicable items, 13,537 have been implemented.

Only 207 remain open, a reduction of 18 percent from the 254 open items identified in the Commission's June 1989 letter to you.

About 70 percent of the remaining 207 open items are expected to be implemented by the end of Calendar Year 1991.

From a plant perspective, the TMI Action Plan has been fully

implemented at 24 of the 113 licensed facilities.

Six plants i

account for about one third of the remaining open items:

Browns Ferry 1, 2, and 3 (53 items), Salem 1 and 2 (10 items),

1 and San Onofre 1 (6 items).

In addition, two plants Rancho Seco (3 items) and Shoreham (4 items) have indefinitely suspended all TMI item schedular commitments in conjunction with the decision to cease operations.

The remaining 81 facilities have from 1 to 4 unimplemented items.

I can assure you that the NRC will continue to monitor closely licensee actions and commitments at facilities with unimplemented items.

Purpose:

To inform the Commission of the status of implementation of Tit! Action Plan requirements.

Discussion:

The enclosed information presents the implementation status of the Till Action Plan and highlights progress made since the June 1989 response to Congressman Markey and the nemorandum of Hovember 14, 1989, to the Commission, subject as above. presents the overall status and progress achieved to date. Enclosure 2 presents estimated implementation time-frates for the renlaining open items. Enclosures 3 and 4 provide the number of open items by plant and by major area respectively. details the items listed as open in the response to Congressman Markey and identifies their current status.

staff found that the valve testing data previously referenced by the licensee was for valves that are not similar to the Ft.

Calhoun block valves. The licensee has committed to test i

similar valves by December 31, 1990. With regard to the plant safety parameter display system (SPOS) console, the staff is i

currently reconciling differences in status that may exist-between licensee responses to Dr. Murley's letter of April 14, 1989, which requested licensees to review and report THI item implementation status and Generic Letter 89-06, " Safety Parameter Display System," which required licensees to certify compliance with SPDS design criteria.

As shown on Enclosure 2, about 70 percent of the remaining 207 open items are profected to be implemented by the end of calendar year 1991. Although some slippage in dates has occurred, all schedule changes for implementation of all TMI Action Plan items remain within the tineframe stated in the response of June 15, 1989, to Congressman liarkey. There are currently eight items that have not been assigned implementation dates by licensees.

f Seven of these items are associated with two plants Rancho Seco and Shoreham, whose licensees have indefinitely suspended all Tit! item schedular commitments in conjunction with their decision to cease operations at these facilities. The remaining item without a date is associated with Haddam Neck where the licensee is evaluating procedures to satisfy the requirement, but has not established an implementation schedule.

From a picnt perspective, the TMI Action Plan has been fully, imp'lemented at 24 of the 113 licensed f acilities. As shown on, six plants account for about one third of the 207 remaining items: Browns Ferry 1, 2 and 3 -- 53 items, Salem 1 and 2 -- 10 items, and San Onofre 1 ---6 items. The remaining l

83 licensea facilities have one to four unimplemented items.

From an issue perspective, four major areas account for about three fourths of the 207 remaining items, as shown in Enclosure 4: detailec control room design review -- 77 items, plant SPDS console -- 45 items, technical specifications -- 17 items, and accident monitoring -- 15 items.

l In summary, over 98 percent of the TMI Action Plan requirements j

have been implemented at licensed plants and significant progress has been made on closing the remaining open items.

The staff's review conclud(d that the valve testing dita previously referenced by the licensee was for valves that are not similar to the Ft. Calhoun block valves. The licensee has connittec to test similar valves by December 31, 1990.
