NOTICE OF VIOLATION Cintichem,' Incorporated Docket Nos. 50-54 Tuxedo, New York 70-687 As a result of the special team inspection on February 9-16 and 26,1990, and in accordance with the " General Statement of Policy and Procedures for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (Enforcement Policy-1988), the following violation was identified.
Sections 3.9.3(1), (2) and (3) of the Technical Specifications for Reactor License R-81 and Sections 5.1.3.a, b and c of Part 1 - Criteria of the NRC-approved license application for License No. SNM-639 requires, in part, that all radioactive liquid wastes be collected in hold tanks, be sampled and analyzed before release and not be eleased if the activity concentration including dilution exceeds that specified in 10 CFR Part 20, Appendix B, Table II, Column 2.
Contrary to these requirements, radioactive liquid effluents were released from the onsite holding pond directly to the Indian Kill Reservoir on three occasions on February 9,1990, prior to being analyzed. Following completion of analyses, the releases were determined to have' I131 concentrations exceeding that specified in 10 CFR Part 20, Appendix B, Table II, Column 2.
This is a Severity Level IV Violation (Supplement IV.D).
Pursuant to the provisions of 10 CFR 2.201, Cintichem, Incorporated is hereby required -
to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending this response time.
