HIGHLIGHTS OF WEEKLY INFORMATION REPORT Week ending March 16, 1990 Browns Ferry, Units 1, 2 and 3 On March 8,1990, the staff granted a Temporary Waiver of Compliance for Condition of Operations (LCO) of the Browns Ferry Technical Specifi-Limiting (TS), regarding Secondary Containment and Standby Gas Treatment Systems cat';ons (SGTS). The staff determined that plant safety would not be unduly compromised 4,
and that not granting the waiver would unnecessarily delay plant startup. All three units are defueled. The waiver will allow expedited support modification work on the Emergency Equipment Cooling Water (EECW) system. The EECW is-required for operability of the emergency diesel generators which in turn are required for the operability of SGTS for secondary containment. The Standard Technical Specifications would not require maintaining primary or secondary containment under current plant conditions. The waiver will remain in effect until March 30, 1990, when the staff will act on the exigent TS amendment. A notice will appear in the Federal Register on March 15, 1990 providing a 15-day comment period.
Palo Verde Trial Support The staff has been requested to provide technical support to the U.S Attorney's office in preparing and presenting testimony for a criminal proceeding. This proceeding is related to the prosecution of certain persons for their alleged participation in a sabotage attempt to disable the offsite power system at the Palo Verde Nuclear Plant, Units 1, 2 and 3.

this support.
BNL will also provide support in this matter. The trial is presently expected to begin in early April, 1990.
1 RES Meets with DOT and DOE RES staff met with staff from the Department of Transportation and the Department of Energy to exchange ideas on the various needs for a data base on radioactive material shipment characteristics, and on potential ways to develop such a data base.
Second Building Status GSA wrote to the Tower Companies on March 15 to clarify some points made by the developer in a letter dated February 28, in which the developer spelled

out the terms of the agreements reached in the February 26 negotiation on the second building. GSA's letter indicates that the Government expects WFN Partnership to forward a draft lease addendum for TWFN to GSA provided the g

Clinton Power Station L
On March 9, 1990, while investigating the cause of low cooling water flow to the essential service water pump room coolers, the licensee discovered that L
an error had been made in the preoperational test which caused essential L
. service water flow to be set below design values on all: room coolers. The condition has existed since initial plant startup in April 1987. The licensee-reported to the NRC via the-ENS that virtually all emergency core cooling, decay heat-removal, and other important safety systems were technically inoperable l
due to possible inadequate room cooling. Systems affected included all high pressure and low pressure core spray, low pressure injection, residual heat removal, standby gas treatment, combustible gas control, and nuclear system L
protection system inverters. Emergency diesel generator, switchgear heat removal, and fire protection were not affected.
The cause of the problem appeared to be that incorrect assumptions were used
~in converting differential pressure measurements across the room coolers to flow. As a result, flow to.the room coolers (which was set by using differential pressure measurements) was adjusted to about half of the design values. The room coolers were supplied by American Air Filters. The licensee had. instrumented the Division I essential service water system for both flow and differential pressure and intends to perform a complete flow balance.
Flow balancing of Divisions II and III will follow and will be completed before startup. The licensee is also performing analysis to determine the safety significance of the low room cooler flows.
The-licensee has also identified problems with microbiological induced corrosion and silt accumulation in other essential service water heat exchangers. The extent of these problems will also be assessed prior to startup.

. localized weld repairs in SG #22. utilizing a temperbead welding process which
~ the staff approved on March 8, 1990. This welding process does not require a
- post weld ~ heat treatment and therefore will minimize the occupational radiation exposures.
A meeting to discuss the results of the recently completed inspection of the steam generators is being held at 9:30 a.m. on March 14, 1990. During this meeting the. licensee is also expected to describe its planned corrective actions to eliminate this cracking problem.
The extensive repairs required to.the steam generators have caused the.
a predicted restart-date to be extended from March 24, 1990 to April 2, 1990.
i License Amendment No. 148 to the Indian Point Unit 2 Operating License was approved on March 7, 1990. ~This license amendment approves an increase in the rated thermal power of Indian Point Unit 2 for 2758 MWt to 3071.4 MWt. This proposed power level' increase was reviewed by the ACRS during its 358th meeting on February 9, 1990.
Indian Point Unit 2 is currently in cold shutdown for inspection of its steam
- generator girth welds.
The licensee expects to begin operation-at the uprated
- power level upon restart which is scheduled for March 24, 1990.

The anonymous memorandum also asserted that NRC inspection reports and other documents have been edited to create'an inaccurate. characterization of the
- Texas Utilities Electric Company's aerformance. Therefore, on October 10, 1990, the Director, NRR, referred t11s matter to the Office of Inspector General (0IG).
In conclusion, the NRR staff has thoroughly evaluated the regulatory matters raised in the anonymous memorandum to the Chairman and has concluded that the issues have been adequately addressed. The conclusions for this review are stated 'in a memorandum dated February 1,1990, from T. Murley to J. Taylor.

Quad Cities' Unit 'I and 2
-At.about 5:00 p.m. CST, on March 13, 1990 a tornado hit the Quad Cites site.
The' station received warning about 15 minutes before the hit and reduced power on Unit 1 from 50% to 40%; Unit 2 was in a refueling outage.
I The tornado damaged the security fence, overturned many trailers, damaged some radwaste vent ducting and caused a minor leg injury to one person. Offsite power was maintained throughout the event. The Region notes that the licensee's response was very good.
The radwaste vent ducting has'been patched, the security fence repaired, and Unit I has been returned to 60% power.
Differing Professional Opinion On October 6,1989, the Director, NRR, received a copy of an anonymous memorandum for NRC staff inspectors to the Chairman, dated October 4, 1989.
-The memorandum asserted that Comanche Peak was not ready for fuel loading and that the draft Systematic Assessment of Licensee Performance (SALP) program report was neither factual nor complete. The Director, NRR, decided to treat the memorandum as a Differing Professional Opinion (DPO), even though the.
memorandum does not contain all the necessary elements specified in NRC Manual Chapter 4125.
To address the accuracy of the draft SALP report, the Director, NRR,.
established a DP0 review Panel to review the evolution of the draft SALP report and to evaluate:the conduct of the SALP process at Comanche Peak.

The panel concluded that the SALP process had been conducted in accordance with Agency-guidance and that draft SALP report is an accurate reflection of Texas Utilities Electric Company's performance during the SALP period. The panel recommended that the SALP report be-issued with several minor revisions recommended by the Associate Director or Special Project. The Director, NRR s
has accepted the panel's recommendation and on February 1,1990, directed the-Associate Director for Special Projects to proceed with the issuance of the SALP report.

g-Office of Nuclear Material Safety and Safeguards Items of Interest Week Ending March 16, 1990 SAFEGUARD 5 AND TRANSPORTATION International International-Atomic Energy Agency (IAEA) Inspection at the General Electric Facility On March 13-1990, an IAEA team began a short notice random inspection at the General-Electric Fuel Fabrication Plant in Wilmington, North Carolina.
The team audited the facility's ledger, weighed and sampled uranium dioxide pellets, and measured fuel rods using nondestructive assay procedures.
- Transportation Meeting on Spent Fuel Burnup
. OnMarch7,1990,DepartmentofEnergy(DOE)representativesbriefedNMSSstaff on research efforts into the. issue of credit for fuel burnup in criticality 4
analyses for transport packages. DOE plans to seek credit for fuel burnup in two of its transportation cask designs being developed under the Nuclear Waste Policy Act. A program overview was presented, followed by interim findings on
' benchmark criticality data, isotopic validation efforts, and fuel rod end effects.
DOE will continue to brief NRC on future developments in the various technical areas.
- INDUSTRIAL AND MEDICAL NUCLEAR' SAFETY Fuel Cycle Safety
- United Nuclear Corporation, Inc. (UNC). Montville, Connecticut On March i12, 1990, UNC announced that they have been notified by the Department of Energy that future orders for the fabrication of. naval nuclear fuel have been terminated. As a result of this notification, UNC plans to gradually-terminate operations at the Montville, CT, facility.- UNC expects to. complete i
the current backlog of work for the Navy by.the end.of 1993, and estimates that shutdown and decontamination of the facility could occur within the next three L

.t' waste disposal and EPRI-sponsored research in this area.- EPRI presented a preview of a briefing that will be given to the low-level waste hest states.
Technical Coordinating Comittee. EPRI has developed a methodology that it believes will more accurately reflect the amount of I-129 waste gen trated' by reactors and disposed of at' low-level waste (LLW) disposal sitec, The EPRI methodology indicates that the I-129 data currently reported on waste disposal manifest records may be at least two orders of magnitude higher than is actually generated and disposed of as LLW. EPRI also presented some-preliminary validation data from operating reactors which were very close to the predicted model estimates.
This industry initiative may lead to more O
realistic estimates of the amounts of I-129 contained in nuclear power plant waste. The more accurately projected inventory numbers shculd assist LLW-disposal license applicants in meeting the performance objectives contained in 10'CFR Part 61 and the conforming Agreement State LLW regulations.
Review of EPA /NRC Guidance on Conducting Inspections at Mixed Waste Facil'ities-As part of the ongoing coordination effort between the Nuclear Regulatory-Commission (NRC) and the Environmental Protection Agency.(EPA), the EPA has submitted draft copies of a document entitled, " EPA /NRC Guidance on Conducting Inspections at Mixed Waste Facilities." ~ NMSS is providing copies of this document to appropriate NRC headquarters and Regional staff for review.
NMSS cxpects to receive NRC staff comments by April 2, 1990. The NRC comments will be forwarded to EPA by April 13, 1990.

Office of Nuclear Regulatory Research Items of Interest Week Ending March 16, 1990 Resolving Safety Issues and Developing Regulations RES Meets with DOT and DOE RES staff met with staff from the Department of Transportation and the Department of Energy to exchange ideas on the various needs for a data base on radioactive material shipnent characteristics, and on potential ways to develop such a data base.
Round-Table Discussion of the proposed Medical Quality Assurance Rulemaking with Agreement States The rulemaking staff from the Division of Regulatory Applications, RES, met with representatives of the Agreement State regulatory agencies from Alabama, Maryland, New York, and Washington on March 14, 1990 to discuss the proposed Part 35 rulemaking to require a quality assurance program for medical use licencees. The purpose of the meeting was to discuss the rulemaking and regulatory guide, solicit comments on how to improve.he. rule and guide, and benefit from the experience of these Agreement State regulators. The all-day discussion was attended by staff from several Commissioners' offices, NMSS, s
AE0D, GPA,.and OGC.
Even though the Agreement State regulators sometimes held opposite views among.themselves on selected requirements, they provided many i
helpful suggestions. Two items of note came out of the discussion.
First, the proposed (as well as currently-in 10 CFR 35.33(c)) reporting requirement for a 7
diagnostic misadministration "such that the patient is likely to receive an organ dose greater than 2 rem or a whole body dose greater than 0.5 rem" is much too. tight because an organ dose of 2 rem is an almost routine result of any diagnostic test. - Also, the proposed rulemaking allows "a physician under the supervision of an authorized user" the same_ authority as the authorized user listed on the license document, e.g., prescribing or_ administering diagnostic tests or therapy.
This may be a questionable practice for the physician just-beginning training in the use of byproduct material. A transcript of the meeting will be available.

AnIncidentInvestigationTeam(IIT)oftechnicalexpertswasidentifiedand dispatched to Amersham Corporation, Burlington, Massachusetts on March 9,1990, to:
(a) quickly resolve questions of radiation exposure; (b) determine what happened; (c) identify the probable cause as to why it happened; and (d) make appropriate findings and conclusions which would form the basis for any necessary
' follow-on actions.
During the period from March 10 to 15 the team deployed in part at the Amersham facility and the Boston warehouse to gather information, examine equipment and conduct' interviews of licensee staff and carrier staff. - Another part of the team initiated fact finding in Los Angeles, California on March 12 where the wooden shipping crate arrived contain'ing the source changers. During the week, the team pursued the sequence of events including cross country shipment routes.
During field investigation activities, administrative and IIT procedural support was provided to the team by two members of AE00. The team was due to return from the field and continue its work at the AE00 offices in Bethesda, Maryland on March 16, 1990.
On' March 16, 1990 the Palo Verde Diagnostic Evaluation Team report was transmitted to the Arizona Public Service Co. The report transmittal letter from the EDO requested a response from the licensee within 60 days.
Division of Safety Programs (DSP)
On March 8 and 9, 1990, AEOD staff, representatives of six utilities, NUMARC,
'and INP0 met in Chicago to discuss the progress of the Maintenance Indicator Demonstration Project. This meeting came at the completion of staff site visits to all six participating utilities, and provided a forum for integrating the information gathered in those sessions. Consensus issues as well as remaining differences on the nature and use of maintenance indicators were addressed.
Current' plans call for the drafting of project sunnary reports by AE0D staff and NUMARC and meeting in April to summarize interim results.

Office of Governmental and Public Affairs Items of Interest Week Ending March 16, 1990 State Programs Econcmic Policy Council Working Group on the National Energy Strategy Harold Denton, Director, Office of Governmental and Public Affairs, accompanied by Spiros Droggitis, State Programs, participated in the Economic Policy Council (EPC) Working. Group on the development of a National Energy Strategy (NES)'onMarch 12, 1990 at the Department of Energy Headquarters in Washington, DC. The Working Group provided consnents on the NES Interim Report. Consistent with regulatory responsibilities, NRC's participation ~ is limited to serving as
.a resource with regard-to NRC's regulatory program and pers)ective, and not as an advocate for any particular role _for nuclear energy in tie overall strategy.
A meeting of.EPC principals is planned for the week of March 19, 1990 at the White House and the release of the interim report for public comment on April 2, 1990.
Advisory Council Named for Proposed LLW Disposal Facility Ohio Governor Richard Celeste announced the appointment of a 14-member citizens advisory council to focus public debate on a proposed LLW disposal facility in southern Michigan. Members of the council are mainly from Lucas County which borders Michigan.
Arkansas Nuclear One Emergency Planning Exercise -
Charles Hackney, Region IV State Liaison' Officer, participated in an emergency planning exercise held at Arkansas Nuclear One on March 13-14, 1990 in Russellville, Arkansas. Mr. Hackney served as a state liaison at the utility's emergency operations facility. The State of Arkansas participated in the exercise.
Meeting with Governor of New Hampshire
- F Sheldon Schwartz, Deputy Director, Office of Governmental and Public Affairs, and Malcolm Knapp, Director of the Region I Division of Radiation Safety and R
Safeguards, met with New Hampshire Governor Judd Gregg and other State officials on March 15, 1990 in Concord, New Hampshire. The purpose of the meeting was to brief the Governor and staff on the status of NRC's review of the New Hampshire Radiation Control Program.
4 South Carolina Radiation Control Program Review Visit A review visit was performed at the South Carolina Radiation Control Program on March 15-16, 1990 in Columbia, South Carolina.
NRC staff participating in the review visit were Carlton Kammerer, Director, State Programs, Riclard Woodruff, Region II State Agreements Officer, James Shaffner, Roy Person, and Robert Shewmaker, HMSS.
Items covered during the visit were: the status of the Agreement State program, NRC's proposed policy on review of States with LLW sites, the State's inspection and enforcement activities and engineering and technical reviews performed by the State.

Bill Introduced To Create Nuclear Safety Comittee in California
. California State Senator. Herschel Rosenthal, Chairman of the Senate Energy and-1 Public Utilities. Committee, introduced legislation to establish an independent, expert, advisory panel to oversee all the State's nuclear power plants..The advisory committee would review the safety, public health and environmental conditions ~of California's nuclear power plants. Under the legislation, the advisory committee would be authorized to perform site inspections following
-l consultation'with the NRC and prepare an annual report witi recommendations.
State Programs is obtaining a copy of the bill for-review.
q International Programs j
Shipping Incident Involving Source Changers from Korea GPA/IP continues,to work with the IIT, HMSS, and AE0D on international aspects of the March 8 incident in which Amersham Industries discovered an unshielded iridium-192 source in a' shipment of supposedly empty source changer devices being returned from Korea. GPA/IP has advised the Korean Ministry of Science and Technology (MOST), the local Korean Embassy, and the U.S. Embassy in Seoul of the radiological contamination incident and asked the Korean Government to.
assist with the investigation in Korea (tracking the route of the shipment and itssource). The Director of the MOST huc1 car Safety and Cooperation Office will be at NRC March-20-22 and will inform the NRC staff of the preliminary l
findings of the Korean investigation.
Interagency Team-Visit to Peru to Discuss Nuclear Cooperation
. Donna Chaney, GPA/IP, re) resented NRC on the interagency team headed by the
. Department of' State whic1 spent the' week of March 5 in Peru for discussions of
' nuclear safety cooperation. The team met with officials from the Peruvian Institute of. Nuclear Energy (IPEN)' in Lima and the Oscar Miro-Quesada de la a
Guerra Nuclear Center in Huarangal. They also visited the Center for Nuclear Medicine, the San'Marcos University Sci col of Veterinary Medicine, the National L
Institute of Agriculture, and the Agrarian University of La Molina - all of R
which either work with or.have projects underway which use nuclear materials.
GPA/IP is drafting for Comission consideration-a paper which will include some o
proposals for a limited cooperative effort between NRC and IPEN.
-International Visitors.
L On Monday, March 12, Professor Yasumasa Togo, a Commissioner of Japan's Nuclear Safety Commission (NSC), had separate meetings with tne Comissioners and Thomas Murley, NRR, to discuss the status of NRC's ABWR licensing review. The NSC is beginning a review of Japan's ABWR design.

" Recruitment of Hispanics" at the Rayburn House Office Building. The seminar was sponsored by the Hispanic Association of Colleges and Universities. Among the speakers were Office of Personnel Management Director Constance Berry Newman, Secretary of Education Lauro Cavazos, and Assistant Secretary of the Interior Louis Gallegos. Several other speakers, including College Placement
'i Officers and Corporate Personnel Executives were also featured.
Federal Women's Program In commemoration of National Women's History Month, the Office of Small and DisadvantagedBusinessUtilizationandCivilRights(OSDBU/CR)andtheFederal Women's Program Advisory Committee developed and presented several employee-oriented initiatives.
A special pictorial exhibit was developed to honor women who started working for the NRC on the day of its inception, January 19, 1975. The collage of over 100 women pictured, and many more identified by name, will be on display on the second floor of One White Flint North outside the Administrative Services Center during the remainder of the month of March.
l The exhibit was first displayed during a special program / reception held on March 15, 1990 at the Crowne Plaza Holiday Inn in Rockville, MD. The program's theme was "A Legacy of Commitment." The keynote speaker was Ms.
Roberta Baskin, Head of WJLA-TV's Consumer Investigative Unit. Other distinguished program participants included Chairman Kenneth M. Carr; Mr. James M. Taylor, Executive Director for Operations; Mr. Hugh L. Thompson, Jr., Deputy Executive Director for Nuclear Materials Safety, Safeguards and Operations Sup> ort; and Mr. William B. Significant Enforcement Actions A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $8,000 and an Order to Show Cause was issued on March 9, 1990 to Certified 1'
Testing Laboratories, Inc., Bordentown, New Jersey. The action was based on the VP/RSO falsifying audit reports for audits that were never performed and willfully providing false information to the NRC in April 1988. The violations are of concern as the NRC must be able to obtain complete and accurate infor-mation from licensees in order to carry out its statutory mission.
The miti-gation and escalation factors in the Enforcement Policy were considered and no adjustment was deemed a)propriate. The Order requires the licensee to show-cause why the license s1ould not be modified to removed the VP/RSO from all licensed activities.

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $5,000 was issued on March 9,1990 to V.A. Medical Center, Des Moines, Iowa.
The action was based on a number of violations that, in the aggregate, were considered to represent a breakdown in control of licensed activities. These violations involved requirements for:
(1) an NRC-authorized Radiation Safety Officer, (2) quarterly physical inventories, (3) contamination surveys (4) wipe tests, (5) monthly checks on the operation of a xenon-133 collection tion safety reviews, (9)(7) dose calibrator linearity tests (8) yearly radia-system, (6) leak tests, calculations regarding concentrations of xenon-133 in designatedareas,and(10)recordsofthetransferoflicensedmaterial. base civil penalty was escalated by 100% because NRC identified the violations and because the licensee had prior notice of similar events.

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $100,000 was issued on March 12, D90 to The Cleveland Electric 111uminating Company (Perry).
In July and November 1989, two control rods failed to properly insert into the core during scram time testing. This action is based on the licensee's failure to properly evaluate unsatisfactory scram time test results, failure to control nonconforming materials in the associated scram pilot valves, and failure to take approariate corrective action for an identified scram time testing deficiency. Tie escalation and mitigation factors of the Enforcement Policy were considered and the penalty was escalated 100 per cent for prior notice and 50 percent for multiple examples. The penalty was mitigated 50 percent for identification and reporting.

A Notice of Violation and Proposed Imposition of Civil Penalty in the an:ount of $3,125 was issued on March 13, 1990 to Thomas Jefferson University, Philadelphia, Pennsylvania. The action was based on an incident in which a 53 millicurie cesium-137 brachytherapy source could not be accounted for and is presumed to have been disposed of in the normal trash, which was taken to a landfill. Mitigation was allowed for licensee identification and reporting of the problem and escalation was applied for poor prior performance in a related area of concern.

.of the Staff to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $25,000 to Iowa Electric Light and Power Company (DuaneArnold). The action was based on an inadequate secondary containment test procedure that failed to detect a significant breach in the reactor i
building ventilation shaft. The civil penalty was mitigated 50% because of the unusual efforts of a system test engineer in identifying the problem.
No further mitigation was applied because the corrective actions, though adequate.

The licensee resaonded to the Notice in a letter dated February 9, 1990 requesting full mitigation
)ased on their prompt and extensive corrective actions. After careful consideration of the licensee's response, the staff has concluded that the additional information concerning the re-evaluation of the design and test procedures for the other HVAC system, changes to the preventive maintenance program and the fact that the plant was not operating during this time period, merits an additional 50% mitigation. Accordingly, because the licensee identified the problem and undertook extensive corrective actions, the staff has concluded that. full mitigation is appropriate and the civil penalty should be withdrawn.

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $50,000 was issued on March 14, 1990 to Commonwealth Edison Company (Zion).
The action was based on a lack of management oversight for the licensed operator training program. Specific violations involved:
(a)aseniorlicensed operator limited to fuel handling standing watch with an inactive license, and (b) the failure to upgrade the Requalification Program when 10 CFR Part 55 was revised in 1987 to require lecture attendance (five control room operators missed seven of 11 scheduled lectures). Though Violation A was reported in an LER, the NRC identified Violation B.
Consequently, the civil penalty was neither mitigated nor escalated.

The action was based on licensee's failures to: have the Radiation Safety Committee (RSC) meet in the second quarter 1988, have the RSC perform an annual review v the radiation safety program in 1988, perform leak tests each 6 months between September 10, 1986, to October 26, 1989, crlibrate survey instruments, perform all steps required for dose calibrator constancy and linearity testing, perform a dose calibrator accuracy test for 1988, and maintain records of waste disposed of through decay-in-storage.

~ Items of Interest Week Ending March 16.-1990 Second Building Status GSA wrote to the Tower Companies on March 15 to clarify some points made by the developer in a letter dated February 28, in which the developer spelled out the terms of the agreements reached in the february 26 negotiation on the r
second building. GSA's letter indicates that the Government expects WTN Partnership to forward a draft lease addendum for TWFN to GSA provided the clarifications are accepted.
0,WFN Cafeteria GSA still has not approved the design and price of the exhaust system for the grill in the kitchen area. A meeting scheduled for March 14 was cancelled by GSA at the last minute because a dispute arose between Tower Companies and GSA estimators as to where the neeting should be held. The GSA project officer indicated to C0115 staff that GSA design staff may now be considering-requiring changes to the design of the hood which they previously approved, and which was subsequently purchased and installed.
The Director, CONS, called and wrote to the GSA Assistant Regional Administrator for Real Estate on March 15 to alert him to the delay and the apparent cause.

High Radiation Levels Reported From Radiation Source in Transit On March 8, 1990, Amersham Corporation, Burlington, MA, informed Region I that a shipment of 14 supposedly empty source changers received from Korea contained an unshielded source.
Radiation levels of 100 mR/hr were measured near the back of the truck that delivered the wooden crate containing the source changers. Other surveys showed 150 R/hr near one source changer; this was 4 to 6 inches from the source, which was found in the unshielded part of the source changer. Amersham has characterized the source to be 3 curies in strength and the isotope to be Ir-19I: by half-value absorption measurements. The shipment traveled by ship from Korea to Los Angeles, CA and thence to Boston and Burlington, MA by commercial trucks. An Incident Investigation Team (IIT) was formed on March 9, 1990, to reconstruct exposures to individuals, determine root causes of the exposures, determine adequacy of the licensee's response and of regulatory controls. The IIT is in the process of locating and interviewing truck drivers and warehouse employees and developing technical details of the incident. A medical consultant from REACTS, Oak Ridge, will assist the NRC in evaluating blood samples obtained from the individuals believed to have received significant exposures. These evaluations will assist in determining the actual exposure to the tested individuals and confirming the lack of medical effect. The IIT will issue daily updated Preliminary Notifications.

Seabrook From approximately 10:30 a.m. until 2:30 p.m. on Saturday, March 10, 1990, up to about 80 Clamshell Alliance demonstrators met outside the South olant gate. There was no civil disobedience and no property damage.
3.
Cintichem, Inc., Tuxedo, N.Y.
Representatives of the NRC, Cintichem and the State of New York attended a meeting of the Laurel Ridge /Clinton Woods Homeowners Association during the evening of March 13, 1990. The Association had requested NRC attendance at the meeting to participate in discussions of the recent leaks of radioactively contaminated water from Cintichem's facility to l
the reseryoir that is the drinking water supply for the two consnunities.
I About 100 people attended the meeting. The State of New York representa-tive reported that its analysis of water samples taken from the reservoir and from the outlet from the water treatment plant revealed low levels of iodine-131. All results were reported to be less than the EPA drinking water standard of 3 picoeuries per liter. The highest level seen in treated water was 1.2 picocuries per liter. The Homeowners Association requested that a public meeting be held before restart of the Cintichem reactor is allowed.

Vermont Yankee George Sterzinger, Commissioner of the Vermont State Department of Public Service, visited the site on Wednesday, March 14. He met with the plant staff and the NRC resident inspectors.

Indian Point 2 Steam Generator Shell Cracking The staff met with Consolidated Edison Company of New York on Wednesday March 14 to discuss the results of their part-cycle steam generator shell inspection and their planned repairs and future inspection schedule.
Modifications made to the steam generators (removal of the down-comer flow resistance cletes) and the main feedwater system (delayed closure of bypass valv*.s) in the June 1989 outage did not stop the cracking which has been observed in the upper transition cone weld in the steam generator shells. The worst steam generator had 42 crack indications, and the worst crack reported to date was 2.25 inches long and 0.53 inches deep. The licensee has not yet fully determined what repairs will be necessary. The staff has requested a submittal from the licensee that would detsrmine the length of operation before the next inspection based on the observed rate of crack growth and satisfying ASME Code specified factors of safety.
This could result in additional inspections prior to the next scheduled refueling outage.

On March 14, representatives of Florida Power and Light were in the Region II Office meeting with members of the Safeguards Section to discuss proposed revisions to their St. Lucie Physical Security and the St. Lucie and Turkey Point Security Training and Qualification Plans.
On March 15, the Regional Administrator and Deputy Regional Administrtor met with the Executive Vice President Nuclear, and the Vice President-Turkey Point Site, FPL, to discuss issues pertaining to the Turkey Point facility.

Solar Testing Laboratories Inc.
An Enforcement Conference was held on March 15, 1990, to address violations which led to the' temporary loss of a moisture density gauge containing radioactive materials. The loss resulted from the failure to store tht; materials in a proper loretion.

An Enforcement Conference was held on March 16, 1990, to address violations which resulted in an exposure of 4.49 Rems while performing industrial radiographv. The causes of the violations and licensee corrective actions are being eva Nated to determine appropriate enforcement ar. tion.

American Radiolabeled Chemical An unannounced inspection of the licensee on March 14, 1990, confirmed that operations were being performed according to provisions of the Order as modified. The Regional Administrator had provided further relaxation of the Order on March 12, 1990, to allow the licensee to subdivide certain labeled materials in stock and to decontaminate certain areas of the facility. The licensee was in the process of training personnel and setting up monitoring equipment in preparation for these newly authorized activities, but had not initiated any expanded operation. An Enforcement Conference is scheduled for April 4, 1990, at 1:00 p.m. with this licensee to discuss causal factors and corrective actions.

Transportation Event, Columbus, Ohio On marcn 13, 1990 a worker unloading a package containing a technetium-99m medical generator from a commercial aircraft at the Columbus airport noticed moisture on the package and on his clothes. Noting the radioactive label on the package, he and his management concluded he was contaminated. The State of Ohio responded to the airport to perform surveys of the package, and the State of Pennsylvania and Region I responded to Pittsburgh to survey the plane (which had left Columbus) and any affected luggage. All surveys were negative. A Region III inspector examined the package on March 14, 1990, and found that the non-radioactive saline solution used to elute the generator had leaked from its container.
The package was returned to Cintichem, the supplier of the material.

Kerr-McGee Initial site work for the construction of the disposal cell at Kerr-McGee Chemical Company's West Chicago, Illinois, site remains stopped. The NRC staff issued license authorization to Kerr-McGee on February 23, 1990, for construction of the disposal cell for thorium mill tailings there.

- 4 actually began because the licensee had not obtained an excavation permit from the city. On March 15, a U.S. District Court judge in Chicago denied Kerr-McGee's request for an injunction prohibiting West Chicejo from enforcing its permit requirement.
In a second case, on March 14 a DuPage County judge issued a temporary restraining order at the request of the Stste of Illinois and DuPage County to prohibit Kerr-McGee from beginning construction. The state and county filed the lawsuit seeking to require Kerr-McGee to apply for permits from the Illinois Environmental Protection Agency under the federal Clean Air and Water Acts. The judge scheduled a hearing for March 23, 1990, on the request for a temporary or permanent injunction.

D. C. Cook and Palisades-On March 14, 15, and 16 the Regional Administrator and members of his staff visited :he D. C. Cook and Palisades facilities. The visits included extenive tours of the plants and discussions with plant personnel.
In addition a management meeting was held at D. C. Cook with the Senior Vice President and members of his staff. The primary emphasis of the meeting was to disr.uss the licensee's plans for improving its maintenance program. The Maintenance Team Inspection at D. C. Cook found its maintenance program to be one of the weakest in the region. A meeting was also conducted at Palisades with the Vice President of Consumers Power Company to discuss general weaknesses in engineering that were identified by a Region Ill Engineering and Technical Suppart Team Inspection.

Davis Besse Nuclear Plant On March 15, 1990, Mr. Edward G. Greenman, Director, Division of Reactor i
Projects and members of his staff held a management meeting with representatives of Toledo Edison Company. The meeting was to discuss the status of the licensee's ongoing sixth refueling outage.

_ Quad Citie. Nuclear Station On L 1.h 13, 1990, a tornado touched down inside the protected arca of the plant damaging some trailers and the security fence, as well as some rad waste building exhaust duct work. One individual suffered minor injuries. Unit 2 was shut down at the time; Unit I reduced power from 55 to 40 percent. Carl Paperiello, Deputy Regional Aoministrator, and William Forney, Deputy Director, Division of Reactor Projects staffed the regional office in response to the licensee's declaration of an unusual event. Two resident inspectors and a region-based security inspector responded to the site and monitored the licensee's compensatory security actions and operations following the tornado.

On March 9,1990, at 2 p.m. CST, Mr. N. S. Carns, Director, Nuclear Operations, announced the appointment of Mr. J. W. Yelverton to the position of Director, Nuclear 0)erations, Arkansas Nuclear One.
Mr. Yelverton currently holds tie position of Operations Manager at MississippiPowerandLight's(MP&L's)GrandGulfStation. Prior to his employment with MP&L, Mr. Yelverton worked at the Grand Gulf Station site with Bechtel, with whom he held a number of positions. Mr. Yelverton has a degree in nuclear engineering from Texas A&M University and holds an SRO license at Grand Gulf Station. As yet, no official reporting date has neen announced, but Mr. Yelverton will be on site part time beginning the week of March 12, 1990.

Commissioners Roberts and Rogers approving and with Commissioners Curtiss and Remick abstaining, approved an order which responds to a question certified to the Commission by the Atomic Safety and Licensing Appeal Board in ALAB-922.
The order indicates that the Commission determined that certain testimony of the Massachusetts Attorney General, which seeks to address the dose reduction / dose consequences that will arise under the New Hampshire Radiological Emergency Response Plan, was not admissible for the purpose mentioned by the Appeal Board nor for any other purpose.
II.
SECY-90-037/037A - Seabrook Immediate Effectiveness Decision / Full Power License The Commission, by a vote of 3-0, with Chairman Carr and Commissioners Roberts and Rogers approving and Commissioners Curtiss and Remick abstaining, approved an order allowing the Atomic Safety and Licensing Board's authorization in LBP-89-32 of issuance of a full power license to become effective.
In addition to providing the Commission's decision on its immediate effectiveness review of the Seabrook station, the order denied the November 17, 1989, motion of Intervenor Massachusetts Attorney General, Seacoast Antipollution League and New England Coalition Against Nuclear Pollution to vacate those portions of LBP-89-32 which authorized the license.
The order also denied the December 1, 1989, stay motion by the same intervenors and the Town of Hampton.
As a courtesy to the parties to permit the filing of judicial stay motions, the effective date of the decision is March 8, 1990.
If motions for a stay are filed with the U.S. Court of Appeals by that date, the decision's effective date will be one week after the relevant motions are filed.
