ALLEGED DISCRIMINATION AGAINST AN EMPLOYEE FOR HAVING ENGAGED IN PROTECTED ACTIVITIES This refers to GSU's [[letter::05000458/LER-1990-001, :on 900103,isolation of RCIC Steam Supply Inboard Isolation Valve Occurred During Surveillance Testing of RCIC Sys.Caused by Technician Lifting Wrong Lead,Causing ESF Actuation.Lead Relanded on Terminal|letter dated January 30,1990]], in response to our letter dated November 2,1989, concerning the alleged discrimination of an employee for having engaged in protected activities. This matter, which involved an employee of. Burns International Security Services who resigned his job at GSU's River Bend Station in 1988 and filed a complaint with the U.S. Department of.

1 Labor, was previously the subject of an April 25, 1989, NRC letter TO GSU and

.a May 31, 1989, letter in reply. After reviewing the information GSU provided l

and the circumstances of this case, we have determined that enforcement action will not be taken at this time. NRC considers this matter closed.

Notwithstanding our conclusions in this case, you should be aware that NRC will not condone discrimination of any type against employees who engage in r

activities that are protected by law and will not hesitate to take enforcement action when the circumstances warrant it.

No response to this letter is required, In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2. Title 10, Code of Federal Regulations, a copy of this letter will be placed in the NRC Public Document room.
