APPENDIX A NOTICE OF VIOLATION Advanced Nuclear Fuels Corporation Docket NO. 70-1257 2101 Horn Rapids Road License No SNM-1277 Richland, Washington 99352-0130 During an NRC inspection conducted on January 8-12 and February 5-9, 1990, a violation of NRC requirements was identified.

In accordance with the " General Statement of Policy and Procedures for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, 1989. The violation is listed below:

10 CFR Part 20 states under " Precautionary Procedures" in Section 20.201(b) "Each licensee shall make or cause to be made such surveys as (1) may be necessary for the licensee to comply with the regulations in this part,.and (2) are reasonable under the circumstances to evaluate the extent of radiation hazards that may be present",

t 10 CFR 20.103(a)3 requires, in part, the use of measurements of radioactivity in the body measurements of radioactivity excreted from thebody,oranycombinatIonsofsuchmeasurementstodetermine compliance with the requirements of 10 CFR 20.103.

10 CFR 20.103(a)2 requires, in part, that'no licensee shall aossess, use, or transfer mixtures of U-234, U-235 and U-238 in soluale form in such a manor as to permit any individual in a restricted area to inhale a quantity of such material in excess of the intake limits specified in Appendix B, Table I, Column-1 and footnote 4 thereto. Footnote 4 to Appendix B,. states, in part, that for soluble mixtures of U-238, U-234 and U-235 in air chemical toxicity may be the limiting factor.

If the percent by weight of U-235 l

is less than 5, the concentration value fog a 40-hour work week is 0.2 milligrams uranium per cubic meter (mg U/m ) of air.

Using a standard 3

p breathing rate of 20 liters per minute, 0.2mg/m corresponds to an intake limit of 9.6 mg uranium per 40-hour work week.

If an adequate reply.is not received within the

. time specified in this Notice, an order may be issued to show cause why the

. license should not be modified, suspended or revoked or why such other action as may be proper should not be taken.

Consideration may be given to extending the response for good cause shown.
