This letter is being' written in accordance with 10 CFR 50.12(a)(2)(ii) to request an-exemption of the specified Local Leak Rate Test intervals to include the next oyster Creek Nuclear Generating Station refueling outage.

10CFR50 Appendix J, Sections III.D.2 and III.D.3 require periodic Type B L

(penetration) Land Type C (valve) testing, respectively. Both criteria require

testing during reactor shutdowns:for refueling but in no case at intervals greater than-two years. Attachments I.and II list.the penetrations'and valves presently within.the scope of.the oyster. Creek Nuclear Generating Station Local Leak Rate Test (LLRT). Program and. the date of the most recent successful completion of each LLRT.

'The'next, refueling. outage-(13R) is presently. scheduled for January 1991. Meeting the two-year inspection interval for LLRT implementation would necessitate a' reactor shutdown prior to the:13R refueling outage schedule date. This would result in an

~1 additional thermal cycle for the plant, as well'as the potential environmental-~

' impacts of-a winter shutdown in order to meet this criteria.

'Similar Technical Specification surveillances, performed on similar p'lant components such as valves, are allowed by the Technical Specifications to extend up to 1.25 times the prescribed interval. This is allowed to minimize the impact.of testing on safe. plant operations.

Although the Type B and C tests as described in.10CFR50 i

C Appendix J do not specify an acceptable extension interval, utilizing the same.

logical: processes would result in an allowable extension of the LLRT performance by 6 months. The extension request to 10CFR50 requirements contained in this letter is

,significantly shorter than the calculated'6-month extension which would be allowed if this testing were performed to meet Technical Specification requirements.

1 Additionally, by allowing the extension of the interval to include the 13R outage, planning and resources can be maximized to more efficiently and effectively complete the maintenance previously docketed in the oyster Creek Integrated Schedule.

Therefore, pursuant to 10 CFR.50.12(a)(2)(ii) it is requested that the next performance of the Oyster Creek LLRT program be er. tended to the 13R refueling outage.
