I am writing to confim that the United States Nuclear Regulatory Commission e

(NRC) has not received a Governor's Certification for the State of Vermont pursuant to the 1990 milestone requirements of the Low-Level Radioactive Weste Policy Asendments Act of 1985 (Act).

i.

According to the Act there are two methods,of meeting this milestone:

1.

Submit a complete license application for a new low-level radioactive waste disposal facility to NRC or the appropriate Agreement State 1

agency; or g

2.

Provide a written certification to NRC by the Governor (or Chief L

Executive Officer, if appitcable) that the State will be capable of i

l providing for, and will provide for, storage, disposal or management of any low-level radioactive waste generated within the State and J

l requiring disposal after December 31,1992.

The certification is to include a description of actions to be taken to ensure that such l

capacity exists.

Section5(e)(1)(F)oftheActalsoallowsStatestomeetthe1990 milestone through disposal agreements with sited Compacts.

States or Compets which do j

not meet the allestone face loss of surcharge rebates from the Jnited States l

Department of Energy (00E), as well as denial of access by the sited States to existing regional disposal facilities.

NRC-has processed and forwarded all certifications received to DOE for its i

surcharge rebate determination.

By no later than January 23, 1990 the NRC will transmit all certifications to Congress and to the Office of the Federal Register for publication.

According to your representative for low-level waste matters, Mr. Phillip i

Paull, Special Assistant, Vermont Advisory Cosmission on Low-Level Radioactive Waste, the State of Vermont does not intend at this time to submit such a certification.

The Vermont legislature is currently considering two pieces of legislation that.will help bring the state into compliance with the i

Low-Level Radioactive Waste Policy Amendments of 1985.

If passed,

- the first bill will allow. Vermont to have a contract for disposal of low-level waste with the Rocky Mountain Low-level Radioactive Waste Board until 1993.;

The second piece of legislation will establish a mechanism for vermont to handle the long term generation of low-level waste.
