Dear Ms. Lytle:
On January 26, 1990, I wrote to The Honorable Madeleine M. Kunin, Governor of Vennont inquiring as to the status of the State's compliance with the 1990 milestone under the Low-Level Radioactive Waste Policy Amendments Act of 1985 (Act). This inquiry was initiated since the Nuclear Regulatory Commission (NRC) did not receive a Governor's certification from the State of Vermont in accordance with the requirements of the Act.
Refer to my January 16, 1990, letter to Governor Kunin (copy enclosed).
We received the enclosed response from Governor Kunin dated January 31, 1990.
'While not a certification as outlined in the Act, the response does set forth the State's position regarding this important milestone and indicates progress toward compliance with the Act. Therefore, NRC is forwarding this response to DOE for your review and consideration. Similarly, we intend to provide copies to the Congress, the sited states officials and to publish the letter in the Federal Register.
