SECY-89-364 - TEN-YEAR LICENSE TERM FOR MAJOR OPERATING FUEL CYCLE LICENSEES I

This is to advise you that the Commission (with all Commissioners agreeing) has approved the policy increasing the license term for major operating fuel cycle licensees from the current five-year period to a ten-year period.. The staff is directed to proceed with the rule changes which would require submittal of the renewal applications at least one year before license expiration.

The Federal Register Notice (with the attached modifications incorporated) should be forwarded for signature and publication once OMB approval has been. received for the two year update of the safety demonstration section which will be imposed by license-condition.

The staff should inform the Commission about any changes in the two-year frequency for. submission and review of safety demonstrations.

The Commission commends the staff for this effort of enhancing safety without increasing the demand for NRC resources.

ACTION:

That the license term for major operating fuel cycle licensees be extended from the current five-year period to a ten-year period.

DISCUSSION:

Notice is hereby given that the license term for ma[or operating fuel cycle licensees (i'.e., licensees authorized to possess and use special nuclear material for reactor and fuel fabrication and/or recovery, pursuant to 10 CFR Part 70, and licensees authorized to possess and use source material for production of uranium hexafluoride pursuant to 10 CFR 40) will be i

increased from the current five-year period to a ten-year period on the next -

renewal of the affected license. The five-year term has been a matter of policy and practice (see 32 FR 7172, May 1967); it'is not in the codified our regulations.

In order to ensure that NRC has a more timely update of the safety demonstration section than the ten year period for license renewal, the NRC has obtained OM8 clearance to require an update every two years.
