NOTICE OF VIOLATION Cleveland Electric illuminating Docket No. 50-440 Company As a result of the inspection conducted on December 27-28, 1989, and January 2-12, 1990, and in accordance with 10 CFR Part 2. Appendix C - General Statement of Policy and Procedure for NRC Enforcement Actions (1989), the following violation was identified:

Technical Specification 3.11.3 requires that radioactive waste be dewatered to meet disposal site requirements when the waste is received at the disposal site.

Contrary to the above, on October 13, 1988, radioactive waste that had been received at a disposal site, the Barnwell Waste Management Facility, was not dewatered to site requirements. Specifically, the waste contained liquid in excess of 0.5% of the waste volume.

This is a Severity Level IV violation (Supplement V).

The inspection showed that steps had been taken to correct the identified violation and prevent recurrence. Consequently, no reply to the Notice of Violation is required and we have no further questions rega ding this matter.
