NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee:

IMPOSITION OF CIVIL PENALTY - $50,000 i

By EN 89-65 dated June 23, 1989, the Commission was notified of the intent of OE to issue a Hotice of Violation and Proposed Imposition of Civil Penalty in the amount of $50,000 to Louisiana Power & Light Company.

This action was based on a violation involving the failure to properly evaluate ASME section XI test results for the B High Pressure Injection Pump.

The licensee responded to the Notice in a letter dated July 28, 1989.

After careful consideration of the licensee's response, the staff has concluded that the violation did occur as set forth in the Notice of Violation and Proposed Imposition of Civil Penalty and that neither reducing the severity level of the violation or mitigation of the civil penalty is appropriate.

Accordingly, an Order Imposing Civil Penalty in the amount of $50,000 will be-issued on or about February 2,1990.

Prior Commission notification of the issuance of this Order is being made because the licensee in this case requested that it make a donation to a university in lieu of payment of a civil penalty.,

Consistent with the Chairman's letter to Senator Breaux, dated January 18, 1990, the staff denied the licensee's request.
