Inspection Report No. 70-1100/89-80 In Mr. A. E. Scherer's letter to me dated' October 31, 1989, Combustion Engineering provided its response to the Notice of Violation enclosed with our letter dated October 2, 1989.

Thank you for informing us of the corrective and preventive actions for both Violations A and B documented.in your letter. These actions will be examined during a future inspection of your licensed program.

Regarding your response to Violation B, it is important to note that the-violation cites an inadequate posting that fails to specify two of the nuclear criticality safety limits, (i.e... the steel container, 5-gallon volume limit and the 1-foot spacing limit), which are required for the safe storage of four.

35-kg fissile mass units within a workhood. Contrary to your contention that compliance with the requirements is " satisfied byl design," (a) containers with volumes greater than 5 gallons are located in this facility, area and could be physically placed within this workhood; and, (b) at' the time-the violation was cited there were no physical barriers installed in the workhood to ensure the 1-foot spacing limit was satisfied. As a consequence,-it appears that neither the " design" of the facility and workhood, nor the posting itself at the time i

of the inspection, were adequate to ensure compliance with these required nuclear criticality safety limits. Therefore, this-violation remains unchanged.
