" DECOMMISSIONING FINANCING" RCFs TU Electric' Letter TXX-89508 dated July 28, 1989 Gentlemen:
The referenced letter requested a schedular, exemption pursuant to-
-10CFR50.12(a) from the provisions of 10CFR50.33(k) that require submittal of a report containing the information designated in 10CFR50.75, including a:

p certification of financial assurance for funds to decommission CPSES.
The requested exemption would authorize-delay.in submittal of the decommissioning
~ funding report for.CPSES until July 26, 1990, the submittal date required of operating plant licensees. This letter is to provide some additional details related to the efforts of TV Electric to comply with the rule.
The decommissioning funding report called for by 10CFR50.33(k) and 10CFR50.75 requires a certification that decommissioning funds will be accumulated by an identified and acceptable method:.and as part of the certification, a copy of the financial instrument obtained to satisfy the requirements is to be included per 10CFR50.75(b).
The rule was adoptad on June 27, 1988.
L TU Electric has aggressively pursued evaluation of the alternatives available L
to the company for satisfaction of the requirements of the rule.
In July L
1988 TU Electric commissioned a study of decommissioning costs by a l
consultant experienced in this type of analysis.
In January 1989, TU Electric l
initiated a study of alternative funding options to determine which is most L
appropriate for CPSES.
The decommissioning cost estimate, along with the financial analyses, will form the basis for the determination of the annual
-funding requirements.
Development of the financial model necessary to evaluate the external funding options under various scenarios was initiated in January 1989.

TXX-89862 December 21, 1989 Page 2 of 2 TV Electric is now in the midst of the process of selecting a Trustee and trust fund managers.
Upon selection of the Trustee, a trust document must be negotiated.
It is hoped that the Regulatory Guide that is to provide guidance to the industry will be issued to assist in structuring this document. The diligent efforts of TV Electric to establish the trust fund continue ~but have E
not been completed-and are expected to take several more months, depending on l
the time required to negotiate and prepare a trust document acceptable to the NRC, the selected trustee and TV Electric.
The exemption being sought will provide the time necessary to complete this planning properly and provide the NRC with an accurate and informed report-that will satisfy the guidance expected from the NRC in the second quarter 1990.
The exemption ultimately will have no effect on compliance with the substantive provisions of the decommissioning rule. TU Electric is only requesting a variance in the schedule for providing the funding report.

TU Electric is not seeking exemption'from any substantive requirement and-fully intends to complete such actions as are required by the rule to assure that funds will be available to decommission CPSES.
