a Appendix A NOTICE OF VIOLATION Lutheran Medical Center License No. 34-01869-01 License No. 34-01869-02 As a result of the inspection conducted on September 2, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:

For Licenses No.- 34-01869-01 and No. 34-01869-02:

10 CFR 35.14(b)(5)(i) requires that each Group VI sealed source or device containing more than 100 microcuries of byproduct material be tested for contamination and/or leakage at intervals not to exceed six months.

License Condition No. 14.A (License No. 34-0186902, Teletherapy) requires that teletherapy sources be tested for leakage at intervals not to exceed six months.

Contrary to the above, (a) your brachythersiv (Group VI) sealed sources, each containing cesium-137 in millicurie quancities, were not tested for contamination and/or leakage between December 18, 1980 and the date of this inspection, and (b) your nominal 4600 curie cobalt-60 teletherapy source was not tested for leakage between April 29, 1980 and December 18, 1980 or December 18, 1980 and July 8, 1981. All of the above intervals are in excess of six months.

This is a Severity Level V violation (Supplement VII).

For License No. 34-01869-01 10 CFR 35.14(b)(5)(v) requires that each licensee conduct a quarterly physical inventory to account for all sources and devices received and possessed. Records of the inventories shall include the quantities and kinds of byproduct material, location of sources and devices, and the date of the inventory.

Contrary to the above, quarterly inventories have not been performed /

documented for your Group VI sealed sources.

This is a Severity Level V violation (Supplement VII).

Appendix A Pursuant to the provisions of 10 CFR 2.201, you are required to submit

.I to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each item of noncompli-ance:

(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full compliance will be achieved. Under the authority of Section 182 of -

the Atomic' Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation. Consideration may be given to extending.your response time for good cause shown.
