APPENDIX A NOTICE OF VIOLATION Virginia Polytechnic Institute Docket No. 50-124 and State Unitversity Licensa No. R-62 Nuclear Research Reactor As a result of the inspection conducted on August 3-7, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7,1980), the following violation was identified.

Virginia Polytechnic Institute procedure VI.6, paragraph II.B provides that changes to procedures may be released provided that the change does not reduce the level of safeguards imposed by the Reactor Safety Committee (RSC).

Such changes must meet certain specified criteria as certified by the reactor supervisor, senior reactor operator and radiation safety officer and be presented for review and approval at the next regularly scheduled RSC meeting.

Contrary to the above, nuclear reactor procedure 11.2, Control Rod Reactivity Worth and Rate fleasurements, was modified in 1980 by a change where no evidence of the change being approved by the reactor supervisor, senior reactor operator and radiation safety officer could be found and the change was not submitted at the next regularly scheduled RSC meeting.

This is a Severity Level V Violation (Supplement I.E.).

Pursuant to the provisions of 10 CFR 2.201, you are hereby required to submit to this office within thirty days of the date of this Notice, a written statement or explanation in reply, including:

(1) admission or denial of the alleged viola-tion; (2) the reasons for the violation if admitted; (3) the correctiva steps which have been taken and the results achieved; (4) corrective steps which will be taken to avoid further violations; and (5) the date when full compliance will be achieved.

Consideration may be given to extending your response time for good cause shown.

Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.

The responses directed by this Notice are not subject to the clearance procedures of the Office of lianagement and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
