Your letter dated January 13,1981, provided reasoas for opposing, and not paying, the additional Class I duplicate fee of $400 we requested for your September 19.

j 1980 application which proposed Classes III and II Technical Specification changes for Point Beach Unit Nos. I and 2.

Your current basis for opposing the additional Clos I fee is that Point Beach Unit Nos. I and 2 share comon Technical Specif1-cations and, as such, there would be no additional administrative effort required for issuing the requested Technical Specification changes for the second unit than there would be if the application was only for one fee class.

We have reassessed our fee position based on the data provided in your letter, and have checked the records on multiple-unit stations with common Technical Speciff-cations (TS). We find that the Point Beach Unit Nos.1 and 2 had previously been categorized as not having comon TS. However, this was in error. Since Point Beach Unit Nos. 1 and 2 do share common TS and the issuance of Amendment Nos. 50 j

and 56 on June 24,1981, approving the application only involved one set of TS pages, we have determined that a second duplicate Class I fee for your September 19 appli-cation would not be fair and seasonable. Therefore, we have concluded that an exemption pursuant to 10 CFR 170.ll(b) from the fee requirements is authorizcd by law, and such exemption is otherwise in the public interest and is hereby granted for the second Class I duplicate fee relating to your application dated Septanber 19, 1980.
