SUBJECT:

MEETING WITH SOUTHWEST-NUCLEAR ON DISPOSAL 0F LLW AT CAREY SALT MINE, LYONS, KA 1.

Purpose:

The purpose of this meeting was to discuss with repre-sentatives of Southwest-Nuclear Company (SWN) the use of the Carey Salt Mine in Lyons, KA for disposal of Low-Level Uastes.

The development of this site impacts on the Sheffield licensing proceedings and the NRC alternatives study.

Discussion: Southwest Huclear Company of Pleasanton, CA has exercised an option ~ to purchase the Carey Salt Mine, formerly the ORNL Project Salt Vault Site and later the intended HLW Repository Site.

SWN was originally contacted by the Lyons Chamber of Commerce to possibly develop the Carey Mine for LLW disposal. They responded with interest and applied to purchase the site. Until recently another organization held the pur-chase rights and when this option expired, SWN placed a down payment on the site.

SWN has been in contact with State Senators Jansen and Berman and the Lyons Chamber of Commerce, all of whom, SWii reported, are eager to develop the mine for LLW.

Governor Bennett, who

objected to the use of Lyons for HLU, has not objected to using the mine-for LLW.

Senator Jansen has introduced legis-lation which would allow Kansas to except land for perpetuity

- and, therefore, enable development of the site.

SUN indicated they would apply for a perpetual storage permit and incorporate i

retrievability in their design and operating plan.

We discussed the corrosion effects on material in a salt mine l

environment and SUN indicated that the environment appeared to be mining days (early ~1900's) quipment which remained from early ideal for waste storage.

E showed little corrosion from the constant temperature (20c) ard relative humidity (50%) atmos-phere. Some-corrosion was, however, present where carbon steel I

was'in contact with moisture and salt (; haft materials).

6 The vclume of the mine currently is 45 x 10 ft and additional space could easily be mined. Additional volume could also be obtained by mining above the present level.

The depth of the present mine is 1000 ft. At this depth loadings on the salt are low and mined cubicles are not expected to close by plastic movement (creep) of the salt.

The American Salt Company is currently mining a site approximately 1000 ft from a section of the Carey Mine.

In addition, several gas wells are active in an area adjacent to the site.

SWM feels that with appropriate controls these activities should not affect waste operations.

SWN indicated that they could dispose of LLW at the same prices charged by NEC0 and Chem-Nuclear.

They would be limited, however, to small packages. The elevator capacity and shaft size would prevent large or heavy it_.as from being transferred into the mine.

SWN indicated a concern for waste form characteristics.

They said a completely dry waste would be required and they might not allow UF solidified waste to be stored.

Conslusions:

In or 'er to operate the mine, SWN needs to improve the elevator assembl t, install power and lighting, install venti-lation equipment and possibly filters, and contruct surface facilties.

g A great deal of work has been performed by ORNL and AEC in the course of their work at Lyons. Therefore, there is considerable infor-1 mation on salt properties, geology, hydrology, mine operations, and site hazards.

The use of the site for LLW disposal appears feas-ible at this time. - SWN, however,-I feel, has greatly underestimated the licensing effort required for a permit. They feel Kansas will issue them a permit for pilot plant operation with actual wastes in 2-3 weeks.

If the facility were to be used_ for retrievable st'5 rage,'

i NRC would need to issue a license due to the la^rge inventory of waste stored exceeding the SNM limits in Part 150.

?f the applicants continue the application for a retrievabie storage facility, the State of Kansas _ will suspend work on the application until the applicant has also applied for a license from the NRC.

This is to avoid duplication of effort since an NRC license will eventually be required by the facility.

f'The applicant has been referring to the proposed operations as " storage" rather than. disp _asO, since

/LMisp,o_ sal would reliiiire that the facility be o vned by

-the State or the Federal government. The st;te of

. Kansas--is-prohibited by law from owning such land; however, the Kansas legislature has passed a bill allowing the State to take title to the land in order that a disposal facility c'ould be legally accepted.

If this bill is not veteed, the applicant is expected to change the facility from retrievable storage to a disposal facility.

In this case, the NRC would not have a licensing role unless Part 150 SNM. limits were exceeded for material in possession.

For a disposal licensing case, the NRC would merely assist Kansas in completing the licensing,ction. This assistance will include providing an Envircnmental Assessment of the project' performing health and safety reviews, acting as a liaison to the Washington office of the MSHA, The NRC will obtain

a contractor to do the technical support for the Assessment. The NRC must obtain from the applicant operational procedures in sufficient detail to begin tork on the Assessment before going out for bids on the

contract, The State may do a portion of the Assessment itself, but the Department of Health and Environment must check on the availability of resources to determine which portions the State can do.

The Environmental Assessment preparation will likely include public meetings in Kansas.

Preparatior, c." the Assessment was estimated to take until the sur:er oi '980.

The Assessment will include financial assurance questions and a feasibility study as a part of the Assessment.

The State will also check on the financial status of the applicant if the Sta tt is to become lar.dlord for the site.

MEETING MINUTES OF NOVEMBER 16, 1979 - MEETING BETWEEN CHAIRMAN HENDRIE AND THE RICKAN0 CORPORATION In a letter dated October 27, 1979 to Chairman Hendrie, Fredrick P.

Beirley, President of Rickano Corporation, Lyons, Kansas, requested a meeting to discuss tneir application to Kansas for a low-level waste disposal site.

During the meeting, Rickano presented the advantages of tie Carey salt mine' facility and clarified some major questions on the operation of i

i the proposed facility.

Rickano clarified the following:

(1) Rickano intends the facility to be a disposal site that is storage with the intent to abandon - the wastes will not be removed; (2) Rickano wishes to limit the wastes accepted to solid, non-flammable, low-activity, institutional wastes; and (3) Rickano has financial backing of one and one-half million dollars, which they feel is sufficient funding to restore the mine for safe operation.

lhe NRC and Kansas agreed to speed the licensing process by reviewing in parallel and minimizing iterations of letters passing between Rickano, Kansas and NRC. Another method of expediting the licensing process discussed was the lack of need for an environmental assessment if the facility was only to be a storage facility. This became a moot point sinca Rickano made it clear that they intended a disposal facility.
