Dear fir. Borchert:

I am pleased to respond to your letter of August 30, 1978, requesting comments on the proposal by Southuest f!nclear Corpany for a ucste facility in 1.yons, Kansas.

I am snrry our reply has laten so long.

In your letter, you requested information on a " repository."

The applicant asked for a license for " retrievable storage." In our responses to your questions, we have addressed both an application for final disposal and temporary retrievable storage of lou-level wastes.

It is our opinion that the environnental effects from a low-level dis-posal f acility and those fron a lou-level storage facility at the Lyons r

pine will be nearl" the sar:e.

It is also our anderstanding that the applicant's ret-vable storage facility was a "de f acto" disposal site.

The costs of i :trieving the eastes and maintaining the vastes in a l

retrievable condition was not addressed by the applicant but are probably prohibitively high.

In vicu of these factors, we feel that consideration l

of the Lyons site be limited to a pernanent dispesal facility.

The lluclear Regulatory Corcission's (NRC's) staff uould like to meet with you and other appropriate Kansas officials to discuss the extent of NRC p-l assistance in this review.

I will contact you to arrange such a meeting. ;

Ue have forwarded the Rickano Corporation's study (sent under cover of your February 9,1979 letter) to appropriate HRC staff for review.

Pecause of the high public interest in the waste disposal issue, and to assure that environnental inpacts of the licensing action are revicued objectively, independently and with full public exposure, ue urge ImC preparation of a documented environmutal assessment, as is now being done on a tri l basis for uraniun nills.
