Appendix A NOTICE OF VIOLATION Detroit Outpatient Nuclear Clinic License No. 21-17011-01 As a result of the inspection conducted on August 26, 1981, and in accord-ance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980),

the following violations were identified:

1.

License Condition No. 14 requires that licensed materia 1 be possessed and used in accordance with statements, representations and procedures-contained in application dated May 22, 1981.

Item No. 10 of this application states that the procedures described in Appendix D, Section 2 of the NRC Medical Licensing Guide will be used for calibration of the dose calibrator. Appendix D requires that quarterly linearity and annual accuracy checks of the dose calibrator be performed and recorded.

Contrary to.this requirement, linearity and accuracy checks of the dose calibrator were not performed since inception of this requiremant.

This is a Severity Level V violation (Supplement VII).

License Condition No. 14 requires that licensed material be possessed and used in accordance with statements, representations and procedures contained in application dated May 22, 1981.

Item No.17 of this application states that the area survey procedures described in Appendix I of the NRC Medical Licensing Guide will be followed. Appendix I states that the method for performing wipe tests will be sufficiently sensitive to detect 100 dpm for the contamination involved.

Contrary to the above requirement, your analysis of wipe tests is not sufficiently sensitive to detect 100 dpm. Specifically, your wipe ttsts are analyzed with your dose cagibrator which has a minimum sensitivity of 0.1 microcuries or 2.2 X 10 dpm.

This is a Severity Level V violation (Supplement VII).

3.

10 CFR 20.401(a) requires that you maintain records showing the radiation exposures of all individuals for whom personnel monitoring is required under 20.202 of the regulations in this part.

f Appendix A Contrary to this requirement, as of the day of the inspection, August 26, 1981, you failed to maintain records of radiation exposures for the period May 10, 1980 through July 9, 1980.

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement 3

or explanation in reply, including for each item of noncompliance:_ (1) cor-rective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full compliance will be achieved. Under the authority of Section 182 of the Atomic Energy-Act of 1954, as amended, this response shall be submitted under oath or affirmation. Consideration may be given to extending your response time for good cause shown.
