Your letter dated June 10,1981 (Serial No. 712), remitted 4adClass III. fee'of
$4,000 for your application dated March 19, 1981, and requested our;reeval6ation of our fee determination on this application. The application proposed an altcr-nate service, vater capability for Davis-Besse Unit No. 1.
It was your Company's position that this submittal was associated with the submittal requirements of Amendment No.18 to License No. hDF-3 issued by the USNRC on July 26, 1979, which included a statement (in tLe transmittal letter) that no fee is required to accompany Toledo Edison's response to the Amendment 18 submittal requirements on fire protection. This statement was included in the July 26 letter because it was the USNRC's decision to exempt from fees the fire protection submittais which were required prior to the issuance of Appendix R to 10 CFR Part 50.
Based on information provided by staff of the Office of Nuclear Reactor Regulation (0NRR), it is our understanding that the Appendix R requirements on alternate safe shutdown superseded the earlier fire protection requirements set forth in the Safety Evaluation Reports and license amendments (e.g., Amendment 18) issued prior to the February 17, 1981 effectiva date of 10 CFR 50.48/ Appendix R.
Therefore, your March 19 application is pursuant to Appendix R and is subject to the fee require-ment of 10 CFR 170.22. On this basis, the previously determined and paid Class III fee is still deemed to be appropriate and applicable for your March 19 application.
