Appendix A NOTICE OF VIOLATION Niles Steel Tank Company License No. 21-04741-01 As a result of the inspection conducted on August 10, 1981, and in ac-cordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:

1.

10 CFR 34.11(d) states that the licensee will have an internal inspection system adequate to assure that commission regulations, commission license provisions and the applicants operating and emergency procedures are followed by radiographers and radio-graphers' assistants; the inspection system shall include the performance of internal inspections at intervals not to exceed three months and the retention of records of such inspections for two years.

Contrary to the above-referenced requirement, it was learned through statements of licensee representatives and the absence of records, that quarterly Jobsite Audits by your Radiation Safety Officer have not been conducted since July 1979.

This is a Severity Level V violation (Supplement VII).

10 CFR 34.29(b) requires that each entrance used for personnel access to the high rediation area in a permanent radiographic in-sta11ation have both visible and audible warning signals to warn of the presence of radiation. The visible signal must be activated by radiation whenever the source is exposed and the audible signal must be activated when an attempt is made to enter the installation while the source is exposed.

Contary to this requirement, as of the d.iy of the inspection, August 10, 1981, the permanent radiographic installation located in your facility did not have the required warning signals installed.

Specifically, there were no audible warning signals to warn of the presence of radiation.

This is a Severity Level V violation (Supplement VII).

10 CFR 20.401(b! requires that you maintain records showing the results of monitoring required by 10 CFR 20.205(b) and (c),

"Protadures for picking up, receiving, and opening packages."

Contrary to this requirement, you failed to maintain records of the monitoring you performed in 1980 of incoming packages con-taining more than three curies of cobalt-60 or iridium-192.

This is a Severity Level VI violation (Supplement IV).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of thi.s Notice a written statement or explanation in reply, including for each item of noncom-pliance:

(1) corrective action taker. and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full compliance will be achieved. Under the authority-of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation. Consideration may be given to extending your response time for good cause shown.
