This is the response of General Electric Company ( d

Electric") to the portions of Board Question 1, contained in the Order Ruling On Contentions Of The Parties, dated June 4, 1980, that relate to General Electric.

Board Question 1 states as follows:

(a)

The Applicant is requested to identify the specific activities which the Applicant is requesting to continue or undertake within the proposed license renewal; (b)

The Staff is requested to identify the activities that the Applicant would be permitted to continue or to undertake within the proposed license ranewal; (c)

Both Applicant and Staff are requested to specify the criteria that will be used to determine whether possible future activities can be performed under the license in effect at that time, in contrast to requiring a license amendment.

(a)

General Electric is requesting a renewal of its g503 S)O license in order to continue to conduct activities at Morris

1 Operation which are currently authorized by Materials License SNM-1265.

The activities now conducted and to be conducted under the requested license consist of the receipt, possession, storage, and transfer of source, by-product, and special nuclear material in the form of irradiated fuel from light water reactors.

Irradiated, or " spent" fuel, is received as fuel in bundle-of-rods configuration and stored under water in storage equipment as described in the consolidated Safety Analysis Report for the Morris Operation, NEDO-21326C, January, 1979 ("CSAR").

At times, fuel may be delivered to a carrier for shipment from Mcrris operation to a licensed facility using N.R.C.-approved shipping casks.

Activities authorized by this renewal do not include dry storage, disassembly or compacted storage of fuel rods.

All activities are and will be conducted in accordance with Materials License SNM-1265.

(b)

This subpart is directed to the N.R.C.

Staff and, accordingly, requires no response from General Electric.

(c)

General Electric believes that the Board's legitimate inquiry contained in subpart 1(c) has been answered by the recent promulgation of 10 C.F.R. 6 72.35.

That section sets forth the criteria about which the Board has asked.

The criteria are:

(1)

The holder of a license issued under [Part 72]

may, without prior Commission approval unless the proposed change, test or experiment involves a change in the license conditions incorporated in the license, an unreviewed safety question, significant

increase in occupational exposure or a significant unreviewed environmental impact:

(i) make changes in the ISFSI described in the Safety Analysis Report, (ii) make changes in the procedures described in the Safety Analysis Report, or (iii) conduct tests or experiments not described in the Safety Analysis Report.

(2)

A proposed change, test or experiment shall be deemed to involve an unreviewed safety question (i) if the probability of occurrence or the conse-quences of an accident or malfunction of equipment important to safety previously evaluated in the Safety Analysia Report may be increased, (ii) if a possibility for an accident or malfunction of a different type than any evaluated previously in the Safety Analysis Report may be created, or (iii) if the margin of safety as defined in the basis for any technical specification is reduced.

General Electric will comply with the criteria specified in section 72.35 and submits that no further response is necessary.
